In a bittersweet move for conservation groups, the FWS just agreed to issue a final listing determination for monarch butterflies by June 6, 2030. It will have taken over a decade and a half for monarchs to get thee protection they need, but it's a victory to finally have a binding date 🦋🦋

We're taking the Trump admin. to court to stop it from allowing endangered species to be killed. In September, FWS director, Brian Nesvik, issued a directive attempting to strip imperiled wildlife of protections from activities that can harm or kill them. In the #ESA, this is known as "take."

As if that's not enough, the legislation also curtails the ability of individuals, nonprofits (including us) and communities to challenge fossil fuel projects by REQUIRING courts to tip the scales in favor of the fossil fuel industry — making it impossible to bring an environmental justice claim.

Under the guise of helping renewable energy, a new legislative package, cynically titled the "Bipartisan American Affordability and Jobs Act of 2026," would give the fossil fuel industry massive long-term structural advantages and lock in thousands of fossil fuel projects.
A manatee floating under calm, clear water, close to the camera and close to the sandy river bottom. Text over the image reads: BREAKING: Legislation was just introduced today in the U.S. Senate that would dismantle protections for hundreds of endangered species in order to speed approvals for corporate polluters.

An argument we keep hearing from the pro-data center crowd is that we can reduce data centers’ climate impacts by powering them with clean energy instead. That’s not true for this reason ⬇️ and more – and also threatens the progress of our already slow energy transition.
