If you don’t probe any deeper than the surface, it may seem as if TERFs have a legitimate concern. They purport to be about preserving all the hard-won, well-deserved gains cis women have fought for over the years.

And they feel by applying those gains to trans women, so we can have those same rights, they’re losing something they worked so hard for.

Because we’re “not women” and didn’t “earn” it. Right there, you can see the transphobe warning lights going off.

The problem is the entire thing crumbles under the very briefest examination.

In order for their entire argument to make sense, you have to believe that gender and biological sex are inseparable. They’re not, and even biological sex isn’t binary.

Gender is a social construct. We made it up. Animals don’t have gender. They can be male or female, or many variations of intersexed, meaning they are born with or without different reproductive organs (spoilers! this happens in humans too).That doesn’t mean gender isn’t real. Money is also a social construct. It is real, but it only has value because we all agree that it does. If we stopped using money and society broke down, money would just be paper and metal, worth no more than their base components.

Gender only exists because we all agree that it does. The lack of it is also real, mad respect to agender folks.

So in TERF ideology, if you’re born with a penis you’re a man, and if you’re born with a vagina you’re a woman. End of story. It’s this outlook that causes them to see and perpetuate the trope of trans women just being “men in dresses, invading cis women’s spaces”.

And they thus see trans men as “confused lesbians” (which doesn’t even address trans men who are attracted to… men! Or are asexual!), and generally think non-binary people are just confused about everything, rather than trusting they know themselves better than anyone else.

TERFs cling to regressive policies for a lot of reasons, a big one being because they were forced to try to meet an impossible standard as cis women, and they believe it's right and good and the only way to be, and all women should be held to that same impossible standard. And it is impossible, and racist, and patriarchal, because cis women have been told all their lives that they simply are not allowed to exist any other way. Be beautiful, be small, make babies, be happy with the scraps you're given and be happy with your proximity to cis male whiteness, because that's all you deserve and that's the best you can hope for. But guess what? As trans women also grow up in this society, we have absorbed all those same messages about what women are "supposed to be."

TERFs are furious that others are free to choose another way. Embracing being trans and non-binary is an affront to them because how dare you reject the power and privilege that you get from all of the gender roles been imposed upon you, and that you've been punished for not following for your entire life? Why can't they choose another way? More spoilers: they can, but choose not to because it was hard and the anger of others doing what they could not is a huge part of their "problems" with trans people.

So TERFs choose to oppress us, when in fact they should be looking at why they feel the way they do. And why they've decided misogyny and gender policing is fine, when they're the ones perpetrating it!
Because it definitely doesn't benefit them, but I'm sure it does benefit the cis white heterosexual standards that are forced on everyone from the day we're born.

Transgender rights activists are spreading misinformation about guidance that protects single-sex spaces by claiming it erodes trans people’s rights, the equalities regulator has said.

Mary-Ann Stephenson, chair of the Equality and Human Rights Commission (EHRC), said criticism of its updated code of practice had made the “real alarm” felt by trans people worse by wrongly suggesting they had lost protections or would face sex checks.

Stephenson said women had also been affected by not having access to single-sex spaces. She said: “Women who believe that their right to privacy, dignity or safety have not been properly protected deserve to have those concerns taken seriously too.”

Last week the Liberal Democrats passed a conference motion branding the code discriminatory and “unworkable”.

At Labour’s conference Joanne Thomas, the general secretary of the Usdaw union and chairwoman of Labour Unions, said the law and the EHRC code would hurt trans and nonbinary people and argued that rights had been rolled back.

Stephenson said the code did not create new law or abolish protections for transgender people.

She said: “Recognising women’s need for access to single-sex services doesn’t require us to dismiss the rights of trans people. And recognising the vulnerability of trans people doesn’t require us to dismiss women’s concerns.”

The EHRC’s code of practice came into force in August, 16 months after the Supreme Court ruled that sex in relation to the Equality Act must be defined biologically. This means single-sex lavatories, changing rooms, hospital wards and refuges must be used based on a person’s birth sex, not the gender with which they identify.

The Good Law Project, which is backing a legal challenge against the code, accused the EHRC of producing “discriminatory” and “unworkable” guidance and said service providers which followed it would be “helping to strip trans pe…

Summary of EHRC EIA
EHRC acknowledges that there are potentially negative impacts for those with the protected characteristic of gender reassignment from the updates to the Code as a result of how service providers implement
FWS.
They state that whilst this may have a negative impact on trans people with a GRC (current or future certificate holders), their view is that it is important the guidance accurately reflects the correct legal position.
EHRC note that these updates reflect the law and will facilitate a better understanding of legal obligations and entitlements. These changes aim
to mitigate the risk of unlawful discrimination or harassment by helping service providers balance the benefits, needs and impacts across potential user groups. Subsequently, this will assist providers in determining whether separate or single-sex provision meets the proportionality test. They state they sought to limit any negative effect in accessing services for those with the protected characteristic of gender reassignment by advising service providers to consider alternatives and mitigations to separate and single-sex services.
OEO additional impact assessment
As set out in EHRC's ElA, the updates to the Code are expected to have a significant impact on people with the protected characteristic of gender reassignment. In addition to the concerns detailed in that EIA, there are further impacts to note as follows.
Exclusion: The updated Chapter 13 provides guidance on when it is lawful to exclude trans people from services aligned with their acquired gender (e.g. domestic violence refuges, hospital wards, and changing rooms) based on their biological sex. It also covers competitive sport which may leave trans people with access to sport. Chapter 12 also provides guidance on restricting membership to an association based on those sharing one or more protected characteristics. Some organisations such as the Women's Institute and Girl Guiding have already made the decision to restrict…'Double exclusion': It is possible that trans people could be barred from both the space aligned with their gender (because of their sex) and the space aligned with their birth sex because of possessing the protected characteristic of gender reassignment), effectively leaving them with no service at all.
Alternative provision: While the Code states it is "unlikely to be proportionate" to leave a trans person with no service (especially for essentials like toilets), providers may lack the funding or space to offer
'third-space' or gender-neutral alternatives.
Involuntary disclosure: New guidance explains how service providers can request information about an individual's sex at birth. This may force trans people to "out" themselves in public or professional settings.
Similarly trans people have expressed concern - as in the Good Law Project litigation against EHRC - that having to use disabled toilets will
'out' them.
Policing of gender: Potential 'policing' of gender presentation, which could lead to increased harassment for trans people and cisgender people who do not conform to traditional gender stereotypes.
Safeguarding risks: Concern that excluding trans women from female services could mean they have to use male services, where they could face a disproportionate risk of violence and sexual assault (although this will depend on the nature of the service in question).
Relations between groups: The debate on single sex services and the treatment of trans people is particularly divisive at this time. The Code of Practice may exacerbate these tensions. This may be somewhat mitigated through careful communications surrounding the Code's publication.
Our assessment is therefore that the likely impacts on gender reassignment as a characteristic are negative, in relation to each of the 3 limbs of the PSED. Mitigating factors are the ability of service providers to create 'third-space' provision for trans people, and the guidance in the Code on when it is, and is not, p…
