A functioning regulatory system would include frequent, randomized spot checks, done regularly by well-funded civil servants using modern technology, plus consequences - fines or jail time - serious enough to actually prevent polluters from sickening or killing nearby people.

States have given billions in tax breaks to the richest companies in the world to bring in their hyperscale data centers. Many states are now cancelling them, leading industry execs to threaten to shift projects to states such as IN, WV & WY that have retained favorable tax regimes.

Kiggans has taken more than $50,000 in campaign contributions from Dominion Energy and NextEra

VIRGINIA BEACH, Va. – Today, former small business owner, 20-year U.S. Navy veteran, and two-term member of Congress Elaine Luria expressed serious concerns about NextEra’s proposed $67 billion acquisition of Dominion Energy and demanded answers regarding any potential increase in energy bills for Hampton Roads ratepayers. NextEra recently implemented a multi-billion dollar utility hike in Florida as energy costs continue to skyrocket for Virginia’s working families.

Elaine condemned the proposed merger in the following statement and called on Jen Kiggans, who has taken over $50,000 from Dominion Energy and NextEra, to do the same:

“This merger is not ready for prime time, and the State Corporation Commission should not approve it as currently proposed. NextEra needs to prove that Virginians will pay less over the long term, our electrical grid will become more reliable, data centers will bear the full cost of the transmission infrastructure their energy demands require, commitments already made to Coastal Virginia Offshore Wind and Hampton Roads will be honored, and that Virginia jobs will be protected,” Elaine said. “If a Florida-based corporation wants control of a Virginia utility franchise, it needs to demonstrate that the transaction will produce lasting benefits for Virginians. Until NextEra and Dominion make those commitments clear, binding, and enforceable, I urge the General Assembly and the State Corporation Commission to oppose approval of this merger.”

VIRGINIA BEACH, VA — The Virginia Beach City Council voted unanimously on Tuesday night to enact a one-year moratorium on large and hyperscale data center permits. This decision makes the Virginia Beach City Council the third city in Hampton Roads to take action locally and comes as calls for a statewide moratorium on data center development grow across Virginia. This moratorium underscores the growing demand for localities to take action on data centers as a result of lawmakers failing to enact stronger safeguards during this year’s General Assembly session.

Following widespread public concern over a potential data center proposal, the Virginia Beach City Council directed staff in June to develop regulations prohibiting new data center development. City staff advised that permanent restrictions would require additional time and are expected to return for consideration in October. In the meantime, this moratorium will halt new data center development applications, preventing projects from moving forward before those long-term protections are in place.

“This moratorium will protect Virginia Beach residents from seeing new data center developments come in while there are effectively no state protections in place,” said Michelle Ueltschi, Hampton Roads Organizer for the Chesapeake Climate Action Network (CCAN) Action Fund. “I am excited to see how the Virginia Beach City Council uses this time to protect its residents from the negative impacts of this fast-expanding industry. Virginia Beach’s action shows that local leaders across the Commonwealth can and should pause data center development until strong, enforceable protections are in place.”
