SENTENCING held on 12/8/2025 for Kyle Travis Colton (1). Court addressed
objections as stated on the record. Govt and defense addressed the court as to
sentencing. Dft did not address the court. Judgment of the Court, Kyle Travis
Colton as to Count 1 committed to BOP for 80 months, $100 SA, $5,000 JVTA
assessment, and $5,000 AVAA assessment, payment to begin immediately, Fine
waived, TSR 60 months, Dft shall comply with standard and special conditions of
supervised release. Court commented on special condition #11 as stated on the
record. Parties request restitution be differed, without Govt objection. Restitution
Hearing set for 3/9/2026 at 09:30 AM in Courtroom 4 (DAD) before District Judge
Dale A. Drozd. Court recommends Defendant be incarcerated at an institution in
Nevada or as near as possible to Mesquite, NV, but only insofar as this
recommendation accords with security classification and space availability.
Appeal rights given. Govt moved for remand. Court addressed defense 111
motion for bail review. After discussion, for reasons stated at today's hearing,

While both versions of the memo asked for 27 months, Judge N pronounced a sentence of 21 months, followed by 3 years of Supervised Release. He's already served 23 months, so it's time served, and he'll remain on release while he appeals the conviction.
