In the pre-publication galleys to his new book, So Ordered: An Originalist’s View of the Constitution, the Court, and Our Country, Justice Alito spelled my last name inconsistently. This is, I suspect, the pettiest possible point on which to open in discussing a Supreme Court justice’s new memoir, and I would never have mentioned it except for the fact that inconsistency turns out to be the organizing feature of the chapter in which I (“the most prolific academic critic of the emergency docket”) repeatedly appear.The central inconsistency of Chapter 8, which is devoted to the emergency docket, is structural: Rather than tackle the subject holistically (as one might expect in a book), Alito mashed together the speech he gave five years ago at Notre Dame Law School with a “postscript.” The former was deeply flawed even at the time (among lots of other things, Alito repeatedly insisted that there was “nothing new” about the Court’s behavior on emergency applications during the first Trump administration and COVID); and the latter tries to move the goalposts away from the specific phenomena to which critics like me have actually objected.The result is to leave readers with a disjointed, inaccurate, and misleading sense of what the debate is even about—to say nothing of how the Court’s own behavior since September 2021 (including Alito’s) has only further undermined the already-flawed claims Alito made back then. Somewhere between the galleys of Alito’s book and the final product (which hits bookstores today), someone apparently figured out that my last name should be spelled the same way (and correctly!) throughout. The other, more significant inconsistencies were, apparently, harder to fix.

The Trump admin's latest strategy to mass generate removal orders is diabolical: - Take a huge group of people with hearings scheduled in late 2026, 2027, or 2028. - Send them a physical letter rescheduling all of their cases to next week. - Those who inevitably miss court get ordered deported.

I have a piece in the NYT today arguing that the law should permit victims of ICE abuse to sue not just individual officers, but supervisors and policymakers like Stephen Miller and Gregory Bovino. A Democratic president and Congress could do this in 2029. And they could make it retroactive.

This will not end w/ voting rights. The fundamental premises of these SCOTUS opinions are: 1) Anti-discrimination is actually unconstitutional discrimination; 2) Intentional discrimination isn't actionable if any alternative rationale is presented. It's the beginning of the end of civil rights law.

Current discussions regarding a bifurcated U.S. economy highlight the increasing economic divide between lower- and higher-income Americans in spending and earnings growth and wealth accumulation. While many households are doing fine and economic activity overall has been expanding at a solid pace, large segments of the population are facing high levels of economic insecurity and financial strain, and consumer sentiment on the whole has dropped to low levels. In this post, we use newly collected data from the Survey of Consumer Expectations (SCE) to update our 2020 analysis of disproportionate financial hardship experienced during the early pandemic and to investigate recent changes in food insecurity and broader economic strains. We then examine how food insecurity relates to the increase in consumer pessimism. We find a remarkable increase in food insecurity, particularly among lower-educated and lower-income households and households with young children. We document a contemporaneous increase in pessimism among the same groups, along with a sharp decline in job-finding expectationsBroad-Based Increases in Food Insecurity and Broader Economic Strains Since 2020
