The Roberts Court, the Trump White House, and the national GOP are acting like this is their one big shot. Either they secure the lasting end of US Constitutional democracy, or they’re in very serious trouble from the backlash. And they’ve already gone so far that there’s no other possibility.

"Levitt: And I think this is worse than blessing partisan gerrymandering: It incentivizes partisan gerrymandering in the worst possible way. The more racist you are as a party, the more insulated you are from Voting Rights Act liability under this decision. If you can make all of your partisan cues about race, then you will never be able to disentangle the two, and you will never face VRA liability. If there were a party called the Klan party, right now, it would trigger an awful lot of nonwhite opposition based on the party’s platform. But this opinion says, you have to set the party’s platform entirely aside to figure out if there’s been any damage based on race. So the more you can tie the two together, the more insulated you are. That means the most racist partisan gerrymandering is going to be the most immune from a VRA challenge. "

In the end, Justice Alito is afraid to stand up and say what his opinions necessarily imply: that Congress cannot do anything to protect minority voting rights short of banning intentional discrimination despite the Fourteenth Amendment’s equal protection guarantee, despite the Fifteenth Amendment’s ban on race discrimination in voting, and despite the fact that both amendments explicitly give Congress the power to enforce the measures by “appropriate legislation.”

Maybe Alito is worried that a ruling forthrightly saying what he is doing would sully the reputation of the court, which has already faced public criticism for killing off another key part of the Voting Rights Act in 2013’s Shelby County decision. Perhaps he is worried that a frontal kill of Section 2 would energize Democrats, leading to greater losses for Republicans in the midterm elections and in future elections.

Whatever the reason, Justice Alito lacks courage, a word which ironically has been embraced by the Trumpiest of judges and legal commentators to describe taking positions that are extreme, unpopular, and I would argue, in conflict with the rule of law.

No one is fooled by Justice Alito’s act of cowardice, unless it is Justice Alito himself. If that’s the case, he is more deluded than he seems to think the rest of us are.

Has the Supreme Court ever previously struck down all or part of a duly-passed, constitutional law on the grounds that Justices feel like the law achieved its goals and feel like the goal would stay achieved without the law so therefore it shouldn’t be in force anymore? Because that’s legislative.

The Senate passed the Voting Rights Act renewal in 2006 by a vote of 98-0. The Supreme Court majority gutted it on the grounds that the Justices personally dislike the impact.

Wednesday’s 6-3 party line decision in Louisiana v. Callais will go down in history as one of the most pernicious and damaging Supreme Court decisions of the last century. All six Republican-appointed justices on the court signed onto Justice Samuel Alito’s opinion gutting what remained of the Voting Rights Act protections for minority voters, while pretending they were merely making technical tweaks to the Act.

This decision will bleach the halls of Congress, state legislatures, and local bodies like city councils, by ending the protections of Section 2 of the Act, which had provided a pathway to assure that voters of color would have some rudimentary fair representation. It’s the culmination of the life’s work of Chief Justice John Roberts and Samuel Alito, who have shown persistent resistance to the idea of the United States as a multiracial democracy, and a brazen willingness to reject Congress’s judgment that fair representation for minority voters sometimes requires race-conscious legislation. It gives the green light to further partisan gerrymandering. It protects Alito’s core constituency: aggrieved white Republican voters. It’s a disaster for American democracy.

Unless I’m mistaken it seems like VRA now means that white people can successfully challenge majority minority districts as drawn with racial animus against white people, but black people cant because they vote overwhelmingly for democrats and gerrymandering for partisan advantage is ok.

Regarding Callais, I think it would surprise the crafters of the 15th Amendment that when they wrote "The Congress shall have power to enforce this article by appropriate legislation," they had left it up to SCOTUS—and not to Congress—to decide what legislation is "appropriate."

Trump started the Iran war illegally, without Congressional authorization or imminent threat, so it's on him. But any time Congressional Democrats try to rein it in with a War Powers resolution, Republicans have blocked it. They enable Trump every step of the way. Wouldn't be possible without them.

Every Democrat's platform for 2026 and beyond must address the needs of real people AND structural reform of our broken government. That includes an expanded Supreme Court, a strong push to make DC & PR states, changes in Senate rules, an end to Citizen's United and serious campaign finance reform.

Hi! A responsible title to this article would have been something like, "Supreme Court Justice Clarence Thomas calls for violent right-wing revolution against most of the American populace".
Thomas called on Americans to stand up for their principles and endure personal "sacrifices," if necessary, to preserve the nation's democracy.

If the Supreme Court votes to repeal birthright citizenship it must be understood as a yet another vote to repeal themselves as justices. A Supreme Court seat doesn’t carry the power to overturn the Constitution. Elected leaders and citizens both must recognize all six of them as illegitimate.
