So much of our constitutional law is pure contingency. Gregg v. Georgia was 7-2, but three of the justices in the majority - Blackmun, Powell, Stevens - renounced the death penalty later in their lives, so the vote by the same court today would be 5-4 to declare the death penalty unconstitutional.

Because it’s completely arbitrary, and generally boils down to people wanting to hire people who are like them. People with the same background, class, and socialization, who know all the same little etiquette rules. This may often be subconscious, but it still hurts people from other backgrounds.
