Cole Allen, May 7: DOJ employees must recuse if they are an alleged victim of a charged crime. Todd Blanche, May 15: I, the undersigned, was a target of the horrific attack at the WHCD. storage.courtlistener.com/recap/gov.us... storage.courtlistener.com/recap/gov.us...
Though disqualification of prosecutors from participation in cases is
uncommon, courts have done so where the appearance of partiality was clear. See,
e.g., Young, 481 U.S. at 807 (finding conflict of interest where prosecutor represented
another party); United States v. Schell, 775 F.2d 559, 566 (4th Cir. 1985)
(disqualifying attorney who joined in criminal prosecution of defendant with respect
to identical matter about which attorney originally counseled client). A DOJ
employee must recuse where he or she is a participant in the events alleged in the
indictment, particularly where they are an alleged victim of said events. For
example, the Ninth Circuit held that where a U.S. Attorney “was a witness to, and
indeed a participant in, some aspect of all of the events alleged in the indictment,” the district court abused its discretion “in refusing to recuse the participating
prosecutor.” United States v. Prantil, 764 F.2d 548, 551, 557 (9th Cir. 1985). The “National Trust for Historic Preservation”—which, again, is not a government agency
of any type—never once denies that its lawsuit is motivated by an irrational desire to stop anything
associated with President Donald J. Trump, which even Democrat elected officials have labeled as
“Trump Derangement Syndrome,” or TDS.1 Plaintiff insists that this suit must move forward
despite the three assassination attempts against President Trump in less than two years, including
the most recent attempted attack against the President, First Lady of the United States Melania
Trump, as well as the President’s Cabinet, staff, leading members of the Press, and thousands of
guests at the Washington Hilton just a few weeks ago, including the undersigned. Plaintiff refused
even to acknowledge the horrific seriousness of that planned massacre, calling it simply the “recent
incident at the White House Correspondent’s Dinner.”

52yrs ago, Richard Nixon was forced out of office for what today seems like petty crimes. Donald Trump tried to overthrow an American election and was put back in power. What happened to us? I sat down with former venture capitalist, current education, innovation & civil society advocate Ted Dintersmith to answer that question.
