The Institute of European and Comparative Law (IECL) of the University of Oxford and the European Law Review bring together in discussion leading academics, including Professor Tamara Ćapeta, Advocate General in Case C-417/23.

The speakers are:

Tamara Ćapeta has served as Advocate General at the Court of Justice of the European Union since October 2021. She was previously a Professor of EU Law at the University of Zagreb, where she co-founded the Department of European Public Law and led several major academic initiatives. Her work focuses on judicial legitimacy and the constitutional dimensions of EU law.

Bruno de Witte is Emeritus Professor of European Union Law at Maastricht University and a part-time Professor at the European University Institute. A leading scholar of EU constitutional law, his work covers the relationship between European, national, and international legal orders, the protection of fundamental rights, and the cultural and linguistic diversity of Europe.

Hanna Eklund is Assistant Professor of Constitutional Law at the University of Copenhagen. She holds a PhD in European Law from the European University Institute and is the Principal Investigator of the project Colonialism and EU Law: Writing Legal Histories for the Future. Her research focuses on EU law, constitutionalism, and the relationship between law and social change.

Nozizwe Dube is a PhD candidate in EU law at Maastricht University, within the Department of International Law. Her research offers a critical race feminist analysis of the EU equality framework, with a focus on intersectional discrimination and the role of decoloniality in European legal structures. In 2023, she was selected as one of the twelve Faces of Science by the Royal Netherlands Academy of Arts and Sciences.

Equality law is an inherently comparative framework, as a claimant must compare themselves to a comparator to establish a presumption of discrimination. What types of comparisons are used in equality claims? Is relying on comparators desirable in equality law? My piece discussing this is out:

The abstract is as follows:
"Comparison plays a sacramental role within EU equality law. However,
comparison also deflects EU equality law from its main task: identifying
and dismantling systems of marginalization that cause discrimination.
This article disrupts the prevailing narrative about comparison as an
inescapable feature of equality analysis. A closer look at comparison
reveals its objective veneer that conceals its commitment to sustaining a
formal model of equality. This makes equality law an assimilationist,
instead of an inclusive device. By deviating from comparison, EU equality
law can advance towards an inclusive understanding of equality that
centres intersectionality. The key therefore lies in the development of
comparator-free equality analysis, which relies on the understanding that
discrimination is contingent on unequal power and resource distribution,
creating systems of marginalization. Hence, instead of comparing a
claimant to a decontextualized intercategorical or intracategorical
comparator, comparator-free analysis conducts a dignitary harm
assessment whereby discrimination is contextualized in the past and
contemporary patterns of disadvantage underlying it to establish a prima
facie case of discrimination."

Statement on Genocide is a Feminist Issue

On International Day for the Elimination of Violence Against Women, Feminist Legal Studies expresses solidarity with all victims of war, genocide, armed conflict, and ethnic cleansing. These are feminist issues because they disproportionately subject those who identify as women, other marginalised groups, and children to particular forms of violence, maltreatment, and premature death. They are feminist issues because these groups are neither defenceless nor passive, but agentic, empowered subjects who are engaged in the project of their own liberation from oppression. They are feminist issues because they lead to the decimation and annihilation of the material means of reproducing life - including and beyond biological reproduction, to networks of care and sociality, such as communities, schools, and universities, to essential services, such as healthcare, land, food, and water supplies - which are foundational for all life and society to flourish. War, genocide, armed conflict, and ethnic cleansing are feminist issues because they are carried out in the service of patriarchal, nationalist, and imperialist regimes of power that are damaging to all people, of all genders and sexualities. 

We join feminists who are today calling for the end to war and violence globally, including for an immediate and permanent ceasefire in Gaza and across Palestinian territories, an immediate end to the ground and aerial bombardment of Gaza, unfettered access for humanitarian aid to Gazans, the release of hostages held in Gaza and political prisoners held in Israel, and an end to the illegal occupation of Palestine. 

Feminist Legal Studies has long been committed to publishing articles that critically explore the relationship between gender, war, and genocide, and we encourage academics and activists to explore and engage with our archive.
