Today, the Legal Defense Fund (LDF) announced it reached a settlement on behalf of the National Association for the Advancement of Colored People
(NAACP) challenging the U.S. Department of Education's anti-opportunity "Dear Colleague Letter," related
"Frequently Asked Questions" (FAQ) document, certification requirement, and EndDEl portal. The lawsuit alleged that the Department sought to prohibit and chill lawful efforts to ensure equal educational opportunities for Black students, and that its guidance rested on a legally flawed interpretation of Title VI and the Equal Protection Clause. Prior on April 24, 2025, LDF and the NAACP successfully secured a preliminary injunction against the certification requirement. The settlement follows the Trump Administration's decision to vacate its appeal in a related challenge.
As part of the settlement, the Education Department agreed that it will no longer rely on the "Dear Colleague Letter" or its certification requirement, nor will it attempt to enforce or reinstate them under a different name. The Department also agreed not to use their "End DEl" portal or related FAQ document. The settlement also preserves the NAACP's preliminary injunction win, which recognized students' right to receive information free from vague prohibitions. The settlement affirms Black students' right to equal opportunity in classrooms and extracurricular activities, including access to inclusive and accurate curricula, selective programs, affinity groups, and policies that foster a sense of belonging.

Following the killing of AFGE Member Alex Pretti and the subsequent slanderous rhetoric that followed from top Trump administration officials, AFGE National President Everett Kelley issued the following statement:

“Yesterday, AFGE brought together labor and faith leaders from Minneapolis and across the nation to mourn our fallen brother from Local 3669, Alex Pretti. We honored his life and legacy and lifted up his family, his friends, his union, Minneapolis, and our nation in prayer.

“Today, we demand accountability.

“In the immediate aftermath of Alex’s killing, DHS Secretary Kristi Noem betrayed the public trust by slandering the good name of our union brother and calling him a “domestic terrorist.” Alex Pretti was a patriotic ICU nurse at a VA hospital who devoted his life to serving America’s veterans. That claim was reckless, defamatory, and unsupported by the facts. Noem was preceded in this false statement by Stephen Miller, Deputy White House Chief of Staff, who is also the architect of the chaotic and failed immigration policy in Minnesota.

“Our demand is clear: Department of Homeland Security Secretary Kristi Noem, who was responsible for carrying out the policy that led to Alex’s needless killing, and Deputy White House Chief of Staff Stephen Miller, the architect of that policy, must resign immediately. If they refuse, President Trump must dismiss them.

Only a few hours after ICE agent Jonathan Ross shot and killed Minneapolis resident and mother Renee Good on January 7, federal immigration enforcement agents descended onto Roosevelt High School property during school dismissal as students were exiting the building. MFE members say that ICE agents tackled and detained a school staff member and union member who was working at the time. The MFE member was since released, according to a union spokesperson. The agents also deployed a chemical irritant against students and staff on school grounds, MFE says. A school official, speaking to MPR News on condition of anonymity, said many students sheltered in a nearby library.

NEW: Data released by ICE shows that virtually the entire growth of detention in the last few months has been among people with no criminal record at all - no prior convictions (no matter how minor) and no pending criminal charges.

There are three lines on the graph: prior conviction, pending criminal charges, and no criminal record. from 2019 through January 2025, "prior conviction" is by far the highest, followed by pending charges much lower down and "no criminal record" the lowest. During the Biden admin, very few people arrested by ICE in the interior and detained had no criminal record. Beginning in January 2025, all three lines jump, but the highest spike is among those with no criminal records. By September, that has become the single largest. Since that point, there are now thousands more people in detention with no criminal record than people with prior convictions.
