The US has at least 36 states and territories with COVlD outbreaks. The apparent wave peak has passed, but transmission remains high across much of the country. States with observed outbreaks include Alabama, Alaska, Arizona, California, Colorado, Connecticut, Florida, Georgia, Guam, Hawai'i, Illinois, Indiana, Kansas, Kentucky, Massachusetts, Michigan, Mississippi, Missouri, Montana, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Oregon, Pennsylvania, Puerto Rico, South Carolina, South Dakota, Texas, the U.S. Virgin Islands, Utah, Virginia, Washington, West Virginia, and Wyoming. From my introduction to the event, summarizing what I learned from this essential book:
I had always believed that the purpose of the Court was to protect the minority against the whims of the majority, And over history, the Justices themselves have wholeheartedly agreed. But which minority? Protecting them from what? And when you think about it, since no population ever has agreed unanimously on everything, the quote "tyranny of the majority," is just a slur for democracy. The people vote on an issue or on candidates, the majority wins, and makes laws. And if laws — made and enacted by a process the Constitution was written to create — can be overturned by just five unelected and unaccountable people, then that is no democracy.

The book details how -- among other things -- that the the real origin of the Supreme Court's claimed power to overturn Federal law as not "Marbury V Madison" but "Dred Scott." And that there was a concerted effort among conservative scholars to convince everyone otherwise.

Tennessee DOC didn't get that statement out until 2 hours after news broke that the state botched yet another execution.
"The Tennessee Department of Correction followed every step of the State’s lawful, established execution protocol approved by the Attorney General’s Office," department spokesperson Dorinda Carter said by email Sept. 30. "The lethal injection chemical in the protocol has consistently been effective, and the protocol does not allow for additional procedures beyond what was carried out this evening. Christa Pike has been transported to an off-site medical facility."

I've been covering the death penalty in depth for a dozen years now, and few nights have been as disturbing and dispiriting as tonight. This was a moral, ethical, and legal failure on several different fronts from many different actors. It wasn't *just* SCOTUS, though they sure were a key part.

I got back home a bit ago from Tennessee's execution of Christa Pike. We sat in the witness room for nearly 2 and a half hours as she received two rounds of pentobarbital. She was taken away in an ambulance shortly after that and I can't say for sure if she is dead or alive at this moment.
