What we’re seeing, in real time, is a “Reverse Enabling Act.” The 🇺🇸 system, since WWII, has created an imperial presidency that worked when both parties adhered to laws & norms. Trump doesn’t need Congress to vote to make him a dictator, like Hitler did. He already is one, so long as they don’t act.

What's missing from that brief introductory sentence (that is in the article itself) is the fact that the CBO figure of 100,000 appears to grossly underestimate how many are likely to lose coverage. 281,000 people in just 9 states plus DC, and that's in October alone!!

When I worked at the White House, we constantly had to correct the speeches and memos that started with "The cost of college is rapidly rising." It's one of those zombie ideas that is hard to kill. College can be expensive, and moreso than it was for our parents, but let's get the facts right.

As an American political historian, I can confirm that this Congress has been "almost unmatched in history" in several categories -- sad abdication of its war powers, craven surrender of the power of the purse, weird refusal to conduct meaningful oversight, and an utter failure to pass actual laws.

Great news; yet another court finds that ICE and the DOJ were wrong to declare that Congress secretly mandated detention of millions of noncitizens in 1996 (specifically, anyone who entered unlawfully at some point in the past, no matter how long ago), and that no one had noticed until now.

Constitutional lawyer here. I don't think it would violate the Constitution for the VP/Cabinet to invoke the 25th Amendment, but the intended constitutional remedy for this behavior is impeachment & removal. The fact that that remedy is politically impossible is a scandal and a crisis.

Someone has sure already made this observation but the fact they can convert all those empty warehouses into prison camps means they could have converted them into housing, community centers, job training centers or, hell, libraries or schools all along. It’s always a matter of will not resources.

NEW: Acting ICE Director Todd Lyons told Congress today that local law enforcement in Colorado leaked word of a raid, allowing gang members to clear out of apartments. Those apartments were being cleared out weeks earlier. Tonight, ICE deleted social media posts with the claim.

I’ve seen a lot of questions on these lines, and the quick answer is that once the federal government purchases the property (including the land the warehouse sits on), local governments cannot regulate them or tax them. They are now federal properties and so the Supremacy Clause applies.

🚨HOLY CRAP. The Trump admin just took a SLEDGEHAMMER to due process, largely eliminating the Board of Immigration Appeals process and MANDATING DISMISSAL of ALL appeals (which cost $1,000 thanks to OBBBA) filed after tomorrow unless a majority of the BIA votes to hear the case.
Thus, rather than require such adjudications, the Department is changing its regulations to provide the Board more flexibility in reviewing appeals. Instead, for appeals taken from decisions issued after this IF becomes effective, as explained in
Section IV.A of this preamble, the default will be summary dismissal unless a majority of current Board members vote to consider the appeal on the merits. And such dismissals
will occur quickly—within 15 days of filing the appeal—allowing aliens to seek Federal court review expeditiously, rather than potentially waiting for years for a Board decision that in the vast majority of cases would affirm the underlying Immigration Judge
decision.
