The ability of governments to build and sustain public interest capacity partly depends upon the position of private interests, and the ability and willingness of a government to resist private interest opposition.
The Internal Revenue Service (IRS) built a digital tax reporting service, Direct File, that created significant public value for users.
Direct File depended upon the creation of internal capacity: a government digital service team that could build digital platforms, rather than procuring a product from private vendors. Government control of the process allowed agile development and iterative improvement that would have been impossible under a traditional outsourcing model.
Long-standing opposition to Direct File by the private tax preparation industry, combined with Trump-era downsizing by the Department of Government Efficiency (DOGE), led to the elimination of the tool.

Things got more insane just about as soon as I posted this last night. DHS is now arguing that we cannot even put the names of ICE officers in our lawsuit against those officers. Their position is that, if a defendant works for DHS, they cannot be named in a lawsuit. Never seen anything like it.
All this time, while Defendants have refused to identify Does 4 and 5 or respond to Leo’s discovery requests, the six-month statute of limitations on his FTCA claims has nearly expired. So, on October 6, Leo sought Defendants’ consent to file an amended complaint that (1) adds his FTCA claims against the United States and (2) adds the names of Does 1, 2, and 3. These minimal changes are shown in a redline attached to this filing.
Defendants, however, refused to consent to Leo’s amendments because there is not a protective order in place. One of Defendants’ positions with respect to the protective order is that the “full legal names” of all government employees “should be confidential.” (ECF 109, at 2). That position, apparently, means that Defendants even oppose Leo identifying specific officers in his lawsuit against those very officers based on their misconduct in carrying out their public duties. Because Defendants will not consent to Leo’s amendments, Leo has filed this motion for leave.Justice also requires granting Leo leave to name the Doe officers as defendants. Despite DHS’s remarkable position that all government employees’ names are confidential, parties routinely sue government employees by name. In fact, Rule 10(a) “requires a complaint to ‘include the names of all the parties.’” Doe v. Frank, 951 F.2d 320, 322 (11th Cir. 1992) (per curiam) (quoting Fed. R. Civ. P. 10(a)). “Lawsuits are public events.” Id. Rule 10(a) “protects the public’s legitimate interest in knowing all of the facts involved, including the identity of the parties.” Id. Only in an “exceptional case” can a party’s name be withheld from the public. Id. And that bar is even higher for public employees since their employment “diminishes their privacy interests” given “the corresponding public interest in knowing how public employees are performing their jobs.” Stern v. FBI, 737 F.2d 84, 92 (D.C. Cir. 1984);

Not long after SDDO Cuni’s declaration was filed, a video of the arrest from a nearby
doorbell camera surfaced, and the footage largely contradicts SDDO Cuni’s declaration.
Although there are many discrepancies, the relevant differences are that (1) SDDO Cuni did not
issue or obtain an arrest warrant (judicial or administrative) before arresting petitioner, and (2)
the entire encounter lasted less than 3 minutes, as opposed to 20. Petitioner’s counsel brought
the video to respondents’ counsel’s attention, and respondents have doubled down. SDDO Cuni
filed a “supplemental” declaration that purports to fill in the gaps but essentially retells the
original story.
As for verifying petitioner’s immigration status before the arrest, SDDO Cuni
backtracked on calling the “Law Enforcement Support Center” as he originally described.
Instead, he recounts having entered petitioner’s name on a smartphone app called “Mobile
Fortify,” which SDDO Cuni states “connects instantly to multiple federal and state databases . . .
including DHS’s biometric systems and passport and visa records.” That query returned no
“records indicating Petitioner had any prior encounters with CBP or ICE,” which, to SDDO
Cuni, “indicated that Petitioner was present in the United States without legal entry.”

After the Court required a further submission to explain this incongruity,
respondents submitted an affidavit from Brenden Cuni, a Supervisory Detention and
Deportation Officer with ICE, who was responsible for conducting the background
searches. DE 20-7. Cuni was notified “some time before 5:50 PM” that “Petitioner was detained.” Id. ¶3. He searched five separate federal databases, all of which “yielded
negative results.” Id. ¶5 (emphasis added). Cuni then “issued and signed the I-200,
Warrant of Arrest, and checked off the boxes relating to ‘biometric confirmation of the
subject’s identity and a records check of federal databases . . . .’” Id. Of course, since the
records checks were negative, it was undeniably false, though represented as true in the
warrant, that “biometric confirmation [and] records check of federal databases
affirmatively indicate” that the petitioner lacked immigration status. DE 7-1. Cuni
explains that ICE then processed the petitioner, and in so doing, entered his data into
those various databases. After processing (and after the warrant was signed and
executed), Cuni ordered another officer to run “a second records check of the electronic
federal databases, which then yielded positive results . . . because Petitioner’s information

NEW: Footage from Thursdays shooting shows an ICE agent in a construction vest brandishing a rifle. His name is Brenden Cuni. Federal judges have found multiple arrests involving Cuni unlawful. He has been accused of repeatedly Tasing a handcuffed man and tackling a pregnant woman in Minneapolis.
