An Open Letter to Supporters of Liberty and Democracy: We need an Indianapolis TRUST Act!

An Open Letter to Supporters of Liberty and Democracy:

I am writing to encourage and insist that the City of Indianapolis and all public safety organizations take immediate action to curb the unaccountable and opaque use of surveillance technology such as Flock cameras.

As a civil libertarian, I have had severe misgivings about the nature of and ubiquitousness of the data available to and retained by public safety departments.

Since July of 2025, I have been in communication with Indianapolis Metropolitan Police Department leadership, Flock Safety representatives, and fellow municipal legislators from around the country to investigate the Automatic License Plate Readers and other surveillance technology.

Based on a thorough review of best practices from around the country, by June of 2026 I had determined that Austin, Texas’s Transparent and Responsible Use of Surveillance Technology (TRUST) Act would be the most appropriate and effective municipal policy to bring to bear in order to govern these complex issues.

This proposal will establish strict oversight on how any city departments and police agencies procure, use, and share data from surveillance tools. It would be future-facing by requiring explicit approval from the City-County Council before any City department or agency could acquire or deploy any new surveillance technology. It would require transparency reports detailing data collection, sharing, and storage practices to be published at least four weeks prior to a Council vote. And it would ban outright some obvious improper uses of data, such as facial recognition tech and marketing or product development technology.

In light of today’s revelation that an IMPD officer misused Flock security hundreds of times, I am calling for urgent action by the Council attorney and leadership to bring this act to the full Council at our next meeting.
