The fines *sound* huge to many people. To the bank they are a few weeks of profit at most, provisioned for and paid without a second thought. That is not punishment. It is a licence for criminality. Prosecute the people responsible, or the scandals were be ever end. #r4today

Look at who does get prosecuted: traders, junior staff, the odd department head (who gets probation). In none of these cases was a C-suite executive convicted. A bank cannot be jailed, so shareholders foot the bill, and the multimillionaires who ran it walk away unscathed. #r4today

Bank of America, this week: $1.21bn fine, & the US Treasury says it admits willfully breaking the law. Next day: BoA announced $6.9bn quarterly profit, *after* the charge. It buys back roughly $6bn of its own shares a quarter. The fine is just 20% of one quarter's buyback. #r4today

Look at the money. HSBC, 2012: $1.9bn fine, about 9% of a year's pre-tax profit of $20.6bn, and underlying profit rose 18%. Wachovia's $160m: under 2% of Wells Fargo's profit. JPMorgan over Madoff: about 10% of its 2012 net income. It sounds like big numbers. But these are tiny bites. #r4today

Britain's one big attempt: The SFO charged Barclays over its 2008 Qatar rescue deal. A judge dismissed the charges against the bank after its lawyers argued the whole board had to be implicated. The ex-CEO's case was dismissed for insufficient evidence; three others were acquitted. #r4today

NatWest, UK, 2021, money laundering: £365m deposited by a customer, ~£264m of it in cash. Staff reported suspicions & no appropriate action followed. Convicted, & fined £264.8m. The judge said the bank, though not complicit, was "functionally vital". The executives walked away scot free. #r4today

Standard Chartered, UK-based. 2012: $667m fine and a deferred prosecution agreement over facilitating illegal payments for customers in Iran and elsewhere. 2019: they were fined again, a further $1.1bn, including a £102m UK FCA penalty. A repeat offender, but still trading. #r4today

Wells Fargo: Up to 3.5 million fake accounts. In 2020 it paid $3bn to resolve criminal and civil probes. The ex-CEO paid $17.5m and took a lifetime banking ban, with NO criminal charge. The head of its community bank, the only executive charged, got probation and a $100,000 fine. #r4today
