Wrote about the Roberts Court’s highly selective aversion to identifying racism, echoing the logic of the infamous Korematsu decision, which the Roberts Court has both condemned and imitated. Call it Neo-Korematsu doctrine. www.theatlantic.com/ideas/2026/0...
In Trump v. Hawaii, Roberts wrote that “the forcible relocation of U. S. citizens to concentration camps, solely and explicitly on the basis of race, is objectively unlawful and outside the scope of Presidential authority.” But the author of the Korematsu opinion, having exchanged his white robe for a dark one, would have agreed. After all, Hugo Black wrote that “pressing public necessity”—not “racial antagonism”—motivated the Japanese-internment policy. Black upheld Fred Korematsu’s conviction because he argued that the presence of a national-security motive meant the racism against Japanese Americans didn’t count. And that is exactly the logic the Roberts Court has followed in so many cases. This reasoning—Black’s reasoning—has been reiterated again and again by Roberts and his right-wing colleagues to sanction discrimination against the vulnerable populations targeted by the Republican Party.

The Korematsu decision may be overturned by the “court of history.” But its legacy lives on in the Roberts Court.

Today's Second Amendment decision has little to do with law and less to do with history (which Alito ignores or denies as needed to reach his conclusion). It's all about power—the supermajority shoving its preferred gun policy down our throats with brute force. Odious. slate.com/news-and-pol...
These unanswerable questions, like Wolford itself, show what a doomed endeavor Bruen has been from the start as an attempt to do law. Far from restraining judges, the decision gives them maximum latitude to cherry-pick history in service of their preferred outcome—which, for Republican appointees, is usually a ruling against gun safety. This approach to the Second Amendment is wildly inconsistent with state sovereignty and self-rule, allowing unelected judges to topple democratically enacted gun restrictions based on dilettantish historical divination. There is no law to be found in Wolford. It reads not like the work of a court, but of a super-legislature imposing its ideological hostility to firearm regulations on a citizenry that never consented.

KBJ's dissent: "The court reduces some of Congress’s greatest legislative achievements—federal laws that secure civil rights, environmental stability, healthcare, and more—to nothing more than the wheelings-and-dealings of an especially wealthy private party." www.supremecourt.gov/opinions/25p...
This severance of rights and remedies is a sleight of hand;
it comes by way of the majority’s full-throated endorsement
of a contract analogy even though what secures the rights
at issue is not a contract but a law. Today’s decision magically transforms a federal statute into an invitation to be
accepted or declined, deemed binding only if each particular
defendant has explicitly agreed to be penalized. No matter
that laws, as opposed to contracts, don’t ordinarily work
this way. The trick here is the majority’s effortless conflation of law making and agreement making—two different
sources of binding authority.
The majority’s analysis is spellbindingly straightforward:
Spending Clause statutes are contracts, and contracts bind
only those who consent. Ante, at 6–8. But pulling this rabbit out of the hat requires misconstruing the Spending
Clause and the Necessary and Proper Clause, and ignoring
decades of precedent affirming Congress’s authority to use
the power of the purse to govern. In the end, the Court reduces some of Congress’s greatest legislative achievements—federal laws that secure civil rights, environmental
stability, healthcare, and more—to nothing more than the
wheelings-and-dealings of an especially wealthy private
party. Because I would not so trivialize a federal statute or
the constitutional powers pursuant to which it was passed,
I respectfully dissent.
