It's insane that people are being arrested in London--Milton's city, the "mansion-house of liberty"--for *carrying signs* in support of Palestine Action. Never understood this. The president oversees the executive. Exempting him from an injunction on the rest of the branch out of some reverence for the office always seemed off. But it's especially wrong when it's abundantly clear that the policy in question came directly from the president.

White House and all executive branch officials should make no mistake. Even if POTUS is not directly enjoined, they are under a court order to comply with the TRO or face contempt. Judge Richard Leon explained the well settled rule here:
The Court can properly enjoin enforcement of the Order. “[I]t is now well
established that ‘[r]eview of the legality of Presidential action can ordinarily be obtained in a suit seeking to enjoin the officers who attempt to enforce the President’s directive.’” Chamber of Com. of the United States v. Reich, 74 F.3d 1322, 1328 (D.C. Cir. 1996) (quoting Franklin v. Mass., 505 U.S. 788, 828 (1992) (Scalia, J., concurring in part and concurring in the judgment)). Accordingly, “courts have power to compel subordinate executive officials to disobey illegal Presidential commands.” Id. (quoting Soucie v. David, 448 F.2d 1067, 1072 n.12 (D.C. Cir. 1971)). Thus, when the President issues an unlawful Executive Order, “the proper course is to seek to enjoin a member of the executive branch from carrying out the executive order at issue.” McCray v. Biden, 574 F. Supp. 3d 1, 11 (D.D.C. 2021).

Judge Kelly ordered WH officials to reinstate the news orgs, but he exempted Trump from the order's reach. Courts commonly do this--exempt the president--as a matter of comity, but it may become relevant here that courts have the power to enjoin the president if it's necessary.

Before midnight, DOJ told Judge Kelly the press ban of CNN, MSNow, Politico is based on their National Security reporting. But examples are core First Amendment protected reporting. First howler: WH says it is b/c POLITICO reported GOP Convention was a political disaster.

The First Amendment prohibits Trump from punishing journalists because he doesn't like their coverage, just as it prohibits him from punishing universities because he doesn't like their courses, or from punishing law firms because he doesn't like their clients.
