Maybe it’s worth highlighting that this is/has been project of ending legal immigration because legal immigration since 1965 has been less white. It’s never been about “enforcement of laws” although restrictionists found that focus on undocu ppl helped legitimize their ethnic cleansing project.

I am sure I will regret weighing in here but this piece also uses the profile structure to get at what some of what really matters: how movements stay together and fracture, what goes into organizing, online v offline, how activism sometimes calls for annoying earnestness, etc.

Incredible opinion. It holds that the common ICE tactic of jumping out of an unidentified rental vehicle and seizing suspected noncitizens while masked violates the Fourth Amendment because the *manner* of the seizure is incompatible with a free society governed by the rule of law.

Even though refugees CANNOT apply for green cards until one year after arrival, DHS now claims that the 1980 Refugee Act actually *requires* ICE to “detain and inspect” refugees who don’t have a green card at year one. Reaching this conclusion required overturning decades-old interpretations.
III. Prior Policies
Past policies on this topic include a Memorandum from James Chaparro, ICE Director of Detention and Removal Operations, titled Detention of Refugees Admitted Under INA § 207 Who Have Failed to Adjust to Lawful Permanent Resident Status (May 10, 2010) (Chaparro Memorandum).
Under those policies:
Failure by a refugee to obtain LPR status, by itself, was not treated as a basis for removal and was not considered a proper basis for detention.
If an unadjusted refugee was arrested, DHS was required, within 48 hours, to either: (1) release the individual or (2) initiate removal proceedings by issuing a Notice to Appear. If it became apparent earlier that no ground of inadmissibility or deportability applied, the individual was to be promptly released.
IV. Rescission
DHS rescinded the Chapparo Memorandum on December 18, 2025.2 While ICE believes the December rescission is valid, DHS has undertaken a fresh look at the past policies and rescinds them anew. For the reasons stated below, we rescind the Chaparro Memorandum and any other policies that conflict with the policies stated in this memorandum.

They stand in the shadow of the old garrison, where a little less than 200 years ago, 1,658 prisoners, most of them women and children, were held during a brutal winter as punishment for the Dakota uprising of 1862. Hundreds died of hunger and disease. An Episcopalian priest pleaded for clemency, and when spring came the government loaded most of the prisoners onto steamboats and deported them to reservations in Nebraska and South Dakota. Henry Whipple couldn’t save them all; of the 303 initially sentenced to death, 38 Dakota men were hanged in what remains the largest mass execution in American history. The Whipple Federal Building opened in 1969, and activists have been trying to get the bishop’s name scrubbed from its walls since Trump’s first term. Government attorneys are working around the clock to keep immigrants locked up in Whipple, where detainees say they’ve been denied food and medical care.
