![In response, the People offer reasonable refutations of the circumstantial evidence offered by the defense on the intent element. The City Attorney's social media posts preceded Israel's military escalation and thus do not necessarily indicate disagreement with or bias against the protesters. But the defense asserts that an anti-Palestinian inference can be drawn from the language that "[e]very - 5 - moral person must support Israel defending her people," suggesting that those who oppose Israel's actions are immoral. (Flynn Declaration, at pp. 19-20.) When the social media posts are considered in tandem with Ms. McGinnis's assertion of an unwarranted prosecution of a pro-Palestinian protestor because of the City Attorney's political beliefs, the inference of animus against the pro-Palestinian protests does constitute "some evidence" of intent, as required for this threshold element, even if the better inference is the one urged by the People.](https://cdn.bsky.app/img/feed_thumbnail/plain/did:plc:qrcrc4zkaavwzwdlpj35ufwm/bafkreif7jbptnoncqbwjmjvodjfk4sanl6vef5melzbquv3r6nod7sdchy)
