In June I went to a Berlin bar to watch the World Cup and found a huge swastika on the toilet wall. I reported it and a fellow customer got furious and said, stop telling other people about it, it’s bad for business. I went back to the bar for an election night party, the swastika was still there.
Top image: a photo of a swastika I saw at a Berliner bar in mid June. Bottom image: same swastika which the bat said they would remove. Still there, partly obscured by graffiti from a local.

Justice Alito devotes an entire chapter of his new book to the emergency docket—and to responding to people like me (“the most prolific academic critic of the emergency docket”). As I explain over at “One First,” it … didn’t go well: www.stevevladeck.com/p/256-so-une...
In the pre-publication galleys to his new book, So Ordered: An Originalist’s View of the Constitution, the Court, and Our Country, Justice Alito spelled my last name inconsistently. This is, I suspect, the pettiest possible point on which to open in discussing a Supreme Court justice’s new memoir, and I would never have mentioned it except for the fact that inconsistency turns out to be the organizing feature of the chapter in which I (“the most prolific academic critic of the emergency docket”) repeatedly appear. The central inconsistency of Chapter 8, which is devoted to the emergency docket, is structural: Rather than tackle the subject holistically (as one might expect in a book), Alito mashed together the speech he gave five years ago at Notre Dame Law School with a “postscript.” The former was deeply flawed even at the time (among lots of other things, Alito repeatedly insisted that there was “nothing new” about the Court’s behavior on emergency applications during the first Trump administration and COVID); and the latter tries to move the goalposts away from the specific phenomena to which critics like me have actually objected. The result is to leave readers with a disjointed, inaccurate, and misleading sense of what the debate is even about—to say nothing of how the Court’s own behavior since September 2021 (including Alito’s) has only further undermined the already-flawed claims Alito made back then. Somewhere between the galleys of Alito’s book and the final product (which hits bookstores today), someone apparently figured out that my last name should be spelled the same way (and correctly!) throughout. The other, more significant inconsistencies were, apparently, harder to fix.

A hallmark of democratic backsliding is government leaders stealing from taxpayers and using public funds to try to get themselves electoral advantages. Backsliding countries keep the form of elections, but corrupt leaders render them no longer free and fair by putting a state thumb on the scale.

"Anti-immigrant march" is such a telling phrase. An immigrant is just a person who exercises the freedom they are born with, which is recognised by all human rights legislation, and moves across imaginary lines on the ground. Being "anti-immigrant" means anti-movement, anti-freedom and anti-person.

Statement from the Black Women Player Collective regarding the commentary towards Jordynn Dudley this weekend in North Carolina vs Gotham.
Instagram post reading: During Saturday's September 19th Gotham FC vs. NC Courage match, commentary following an incident where Jordynn Dudley's hair was pulled in the 53rd minute crossed a line into unfair critique.
Hair pulling is an objective foul, regardless of intent. Yet instead of addressing the infraction, commentators criticized Jordynn's hair length, framing the foul as a "consequence" of her style and a "risk" to opposition players.
A player's hairstyle should not be used to shift responsibility for a foul onto the player who was fouled. Players should be able to wear their hair in a way that reflects who they are without it becoming justification for unfair criticism when an opponent commits an infraction.
Congrats on the brace and cinching, Jordynn. Good luck in the playoffs.
