NEW: about 48 hours after this incident in Evanston, DHS had provided a statement, saying the man was “not cooperative” after agents identified themselves and said they “later left the scene without further incident once the individual finally identified himself.”
On September 20, during a targeted enforcement operation in Evanston, Illinois, ICE encountered an individual who resembled the target. ICE approached the individual and immediately identified themselves as law enforcement. The individual was given lawful commands but was not cooperative and refused to identify himself. ICE officers relied on their training and later left the scene without further incident once the individual finally identified himself. 

 

ICE has authority for lawful arrests where authorized under 8 USC 1357. Law enforcement officers use ‘reasonable suspicion’ to investigate immigration status and probable cause to make arrests consistent with the statute and the Fourth Amendment to the U.S. Constitution. The Supreme Court has already vindicated us on these practices. 

 

DHS enforcement operations are highly targeted, and officers do their due diligence. We know who we are targeting ahead of time. If and when we do encounter individuals subject to arrest, our law enforcement is trained to ask a series of well-determined questions to determine status and removability.

Today, EPD responded to a sighting of federal agents at Dodge/Howard, where a US citizen was briefly detained and then released. The person was treated at St Francis hospital for minor injuries. EPD continues to investigate the situation, and we will remain vigilant about federal activities.

A few additional highlights from the feds’ Broadview 6 filing: U.S. Attorney Andrew Boutros was emailed a transcript of the 10/9 grand jury session in October but says he didn’t review it and problematic conduct was not brought to his attention until late April:
As to the other grand jury issues, the United States Attorney informed the Court that he first
learned of the “vouching” and ex parte conversations in late April 2026.9 Id. at 51-53. The United
States Attorney noted that he moved to dismiss the indictment based on his discovery of the
vouching and ex parte communications because “we wanted to moot whatever had taken place in
the grand jury.” Id. at 51-53, 57-58.
Since that time, the AUSAs on the trial team as well as Experienced AUSA 1 have self-
reported this Court’s comments—and the entirety of this matter—to the Department of Justice’s
Office of Professional Responsibility (“OPR”), which is the component of the Department
responsible for conducting an independent review of allegations of misconduct. 28 C.F.R. § 45.12;
Justice Manual § 1-4.200, et. seq. Moreover, as discussed in detail below, the United States
Attorney conducted a root cause analysis of the underlying issues giving rise to the dismissal of
the indictment and information in this case and has taken numerous remedial steps to help ensure
that the missteps that occurred here do not happen again.
9 The United States Attorney was emailed a copy of the transcript from the October 9, 2025, grand jury
presentation on October 14, 2025, but has no recollection of reviewing the transcript at that time, and is
quite certain he did not review the transcript at that time. The United States Attorney did not receive a copy
of the October 16 or October 23, 2025, transcripts until late April 2026, shortly before the Government
moved to dismiss the indictment. At that time (late April 2026), the United States Attorney reviewed
relevant portions of all three transcripts. Irrespective, no one ever brought the vouching or ex parte issues
to the United States Attorney’s attention until late April 2026, nor was the United States Attorney aware of
the vouching or ex parte issues until late April 2026.

The city's argument on why this matters: "The Government was aware of this litigation and the potential implications of its alleged interests over two years ago ... A timely motion to intervene would have been filed shortly after this case began.”
Here, conspicuously absent from the Government’s motion to intervene is an answer to the question of when the Government first learned of this litigation. See ECF No. 48–49. That is because the answer makes clear that the Government’s motion was unreasonably delayed. The Government was aware of this litigation and the potential implication of its alleged interests over two years ago. The Government’s own communication to Evanston in June 2024, just over a month after the case was filed, stated that the Government was “monitoring” the case. See Ex. 1. It then met with Evanston shortly thereafter on July 3, 2024. See Ex. 2. A timely motion to intervene would have been filed shortly after this case began. At that time, the Government knew or should have known that the alleged interests it seeks to protect now might be affected by the outcome of the litigation. A motion for intervention must be timely; the Government’s motion here was not.

Stat is true, but it's due to people who use ERs for primary care delaying visits while social distancing. So, ER visits fell but ICUs were full due to an influx of COVID patients.
