Pretty cool scholarly milestone: my article, Administrative Exhaustion after Perez, has been cited in a petition for a writ of certiorari filed with the U.S. Supreme Court.

Some pretty staggering numbers from ED-OCR: the office began 2025 with approximately 19,000 pending complaints, received a record 23,879 new complaints that year, and resolved roughly 1% of its pending inventory. OCR’s inventory now exceeds 40,000 complaints and grows by about 2,000 *per month*.

Great framing of one the major challenges confronting the Left's broader reconstruction effort. The way I've been thinking about bridging the gap is by focusing on the problem of power disparities. I applied this framework to the issue of regulatory public participation. fas.org/publication/...

Working my way through @ksabeelrahman.bsky.social ‘s excellent new piece in the @nyulawreview.bsky.social. nyulawreview.org/wp-content/u...
“Understanding the deregulatory and repressive components
as co-equal parts of a broader theory of the administrative state is
crucial, because our conventional administrative law frames simply
do not capture these dynamics accurately. Rather, what we see is an
opportunistic borrowing of both big and small government, the language
of both checks and balances and unitary executive in ways that combine
to drive a specific and clear vision of social ordering. State authorities
that advance economic, gender, and racial hierarchies are validated and
increasingly empowered, while state authorities that operate to mitigate
against those inequities are the ones most vociferously targeted as
“overreaching” and are in line for dismantling.”

Warren Burger's response when a deaf lawyer asked for real-time transcription (at the lawyer's expense) when arguing before the Court (in a case about disability access!).
A memo from the Chambers of the Chief Justice on January 26, 1982, in the case of Hendrick Hudson Central School District v. Rowley:

"MEMORANDUM TO THE CONFERENCE.
"We have another 'first' under the attached material.
"Question: Is this different from a lawyer who can't understand English or who is a deaf mute and who, therefore, needs an 'interpreter' to convey our questions?
"The oral argument is for our benefit. It is not a right of a party.
"Regards, WEB."
