As an expert on sexual violence, I have to add that these ethical violations are a nightmare for interviews on sensitive subjects. I would never recommend ANY survivor goes public with their story at an outlet that would do this to them.

And still, all of it could have been avoided if USA Today respected the experts they interview. They could have been one of the only publications to get it right *from the beginning* by platforming the concerns that sexual violence researchers had as soon as we saw the DA's statement.

The primary objective of journalism is supposed to be telling the truth. It is a DECISION on the part of USA Today to know that new details have emerged about this case and to refuse to update an old story that is still circulating and still shaming Jane Doe.

Ironically, my original interview with the journalist I spoke with was primarily about how "inconsistencies" can come from gender bias in investigatory processes and then be blamed on survivors. It was the inspiration for this thread--but none of these points made it into any USA Today article:

Suuuuper interesting, I was not tracking this. The judge found the law criminalizing noncitizen voting is a voter qualification statute, and therefore outside of Congress’s power. Surprisingly, this is an issue of first impression! Decision is here: storage.courtlistener.com/recap/gov.us...
The best reading of the actual statute that underpins this criminal case yields an inescapable
conclusion: 18 U.S.C. S 611 is a voter qualification statute, and the Constitution does not authorize
Congress to legislate voter qualifications for federal elections. Except for very specific constitutional
provisions (that cannot support this statute; we will go through them, Congress has no power to say
who can vote or who cannot vote in federal elections-that foundational power is reserved for the States,
and limits Congress.
Some legal principles are so fundamental that they form American constitutional bedrock, and
this case reveals a big one: When you're prosecuted based on a law that Congress did not have the
authority to pass, the prosecution cannot stand. That principle in federal law harkens back to cases
like Marbury v. Madison, 5 U.S. 137, 180 (1803), and United States v. Hudson, 11 U.S. 32, 34 (1812), and
has had explicit and unbroken support in criminal cases since Ex Parte Siebold, 100 U.S. 371, 376-77
(1879) ("An unconstitutional law is void, and is as no law. An offence created by it is not a crime. A
conviction under it is not merely erroneous, but is illegal and void, and cannot be a legal cause of
imprisonment."). The principle is so fundamental that it even predates our constitutional republic; it
lies at the very heart of our constitutional heritage. See, e.g., Bayard v. Singleton, 1 N.C. 5, 9-10 (1787) (striking down a legislative act as unconstitutional and holding that a court cannot enforce an
unconstitutional law in any type of proceeding). This principle acts as a shield for every person facing
criminal prosecution in the United States, citizen and non-citizen alike. That shield protects the
Defendant here, and none of the Government's arguments break through it.

The Trump admin will undoubtedly appeal this case to the 11th Circuit. I have no clue how that will turn out. Florida has its own noncitizen voting crime, so even if this decision is upheld, the defendant could still be prosecuted; and the immigration consequences (deportation) remain the same.

Monterey Bay Aquarium Research Institute (MBARI) captured this slightly less spectacular specimen at 1,000 meters (3,300 feet) deep in Monterey Bay during the summer of 2021. The scientific name "Halitrephes maasi" honors German zoologist Otto Maas, with Halitrephes meaning "sea-nourished".

Because it lives in such deep water, no human stings have ever been documented, but it's related to the Portuguese man-o-war (Physalia physalis), so we can assume it packs a potent punch. In the dark depths, it's nearly invisible. It needs the rover's lights to illuminate the tentacles...
This beautiful hydromedusa, Halitrephes maasi, is most frequently seen around 1,000 meters deep in Monterey Bay during the summer. Its bell can get up to 10 centimeters (four inches) wide.

Halitrephes, at about 1,200 meters (3,935 feet) depth. The ends of its tentacles are packed with nematocysts (stinging cells), which make them appear especially bright.

The July data just released by CERES shows the Earth's Energy Imbalance (EEI) at *only* 1.22 million Hiroshimas per Day (HpD), down from 1.25 million HpD in June. The EEI should continue declining over the next few months as El Niño increases outgoing longwave radiation.

Galena cubes formed first, then silica-rich fluids replaced them — leaving agate in perfect cubic form. A textbook pseudomorph: agate replaced the original galena structure. Rare geometry you don't see often. 🔲
