Well deserved and timely choice at a moment when intl law is under tremendous pressure. 010

Adam Kochanski @adamkochanski.bsky.social · 22/09/2026That’s not how the court’s jurisdiction is triggered though. In the US’ case, it would require an UNSC resolution to refer the situation to the court, and good luck with that. 000

Adam Kochanski @adamkochanski.bsky.social · 24/07/2026Yes, which could be used to infer genocidal intent (as happened in the Srebrenica case). But you would need more than just that and the reports show the way. To say “it’s not even close,” is frankly absurd. 000
Adam Kochanski @adamkochanski.bsky.social · 23/07/2026For those replying: whether genocide has occurred is a *legal* question that requires establishing the dolus specialis of genocidal intent as defined in the 1948 Genocide Convention. Joe’s unsubstantiated take is at odds with an overwhelming majority of genocide scholars, the UN, HRW, Amnesty, etc. 150
Adam Kochanski @adamkochanski.bsky.social · 21/07/2026Based on the Rome Statute, the original UNSC referral still applies, right, to the more recent violence because it’s the situation that’s referred and not a specific case? 110

Adam Kochanski @adamkochanski.bsky.social · 10/05/2026I think this was sound legal strategy at the time, especially given that ICC investigators have yet to be allowed into Gaza. But as the prosecutor says, he can (and I expect will) add charges, which has been the legal strategy in Ukraine where the crime of genocide has also not been pursued. 2/ 000
Adam Kochanski @adamkochanski.bsky.social · 10/05/2026Proving the mens rea of genocidal intent beyond a reasonable doubt is exceptionally hard.
