🚨 SANDAG wants to oppose SB 79 - a bill that would allow housing near transit! Their own plan calls for EXACTLY this, but they're protecting NIMBY cities instead of working folks who can't afford homes. Email clerkoftheboard@sandag.org w/ comment before Friday's 9a meeting

San Diego’s public transit system is at a crossroads. It can either become a world-class network or face cuts that leave people stranded. We need more investment in transit, not cuts. Our CEO @colinparent.bsky.social’s recent VOSD op-ed explains what's at stake: voiceofsandiego.org/2025/02/27/o...

Opinion: Public Transit in San Diego Is at a Crossroads. Its Future Hinges on Investments, Not Cuts.
Less frequent transit attracts fewer riders, leading to a 'death spiral,' with reduced revenues leading to more reduced services.

It may not be cool or hip in some circles, but we legitimately do need a massive amount of people to run for office. Flood the school boards, councils, county seats, state legislatures, Congress, etc. Big changes at the top happen when the ground shifts at the bottom. And that can start now.

San Diego City Council has received a Brown Act complaint over its surprise vote seeking the repeal of the city's ADU bonus program. Attorneys representing an ADU developer also bring up the program's role in San Diego's housing element. Background: www.kpbs.org/news/local/2...
To Whom it May Concern:
Our office represents SDRE Homebuyers LLC, a California limited liability company, and its
principals, affiliates, and subsidiaries. This correspondence is to notify the City of San Diego
(“City”) and its Council Members (“City Council”) that they are violating the Brown Act.
California Government Code Government Code §§ 54950 et. seq. Specifically, the Brown Act
violation that this is in reference to is the inclusion of a non-agenda action (direction to staff) within
a motion acting on an agendized item (331), without adequate public noticing. We have
included your agenda as an enclosure.
Recently, it came to our attention that the City and City Council are attempting to unlawfully
revise/amend the San Diego ADU Bonus program—which is in strict contravention of the Brown
Act and other regulations required by the City and City Council. The violation is further describedbelow.

(Direction given for staff to return to City Council within 60 days with an action item to remove

the City's ADU Density Bonus Program so that the ADU program is consistent with the state-mandated ADU regulations for single-family zoned parcels.)

San Diego’s ADU Bonus program is a required program as a part of San Diego’s certified housing element. AB671 (2019, Friedman) required local agencies as a component of a compliant housing
element, to create incentives for low, very low and moderate income ADUs. The ADU bonus program not only satisfies this requirement but sets the standard by which all other incentives across the state are judged. This program is a key contributing factor to San Diego’s pro-housing designation, and pausing, canceling, hindering, or revoking it would put that designation and the funding opportunities it provides at risk.
The ADU Bonus Program has been recently certified by the California Coastal Commission as a part of the updated LCP implementing changes to the municipal code made back in 2022. The City Council’s motions are unlawful and illegal without proper public notice. Additionally, the motion directs staff to act unlawfully and illegally by modifying/canceling a program that would result in the City and the City Council violating several laws, including but not limited to
the Brown Act. Should you wish to study this program with the intent to improve its efficacy and applicability, we encourage the City and the City Council to start that process in a manner consistent with the
regulations it is required to follow. If you have any questions or would like to discuss this matter further, you may contact me at (619)
546-7880 or shoffman@hoffmanforde.com.
