I’m noticing a trend in employer/employer counsel arguments about scope of constitutional right to strike in Canada. Their argument is that the SCC didn’t actually recognize a “right to strike” in the SFL case. Instead it recognized a right to neutral arbitration. Thus, govt’s can just impose arb.
