However, I think there is enough evidence that a reasonable person could conclude (this is the legal requirement for indictment) that Israel’s actual intent is the destruction (part or whole) of the Palestinian people rather than its claimed intent of the destruction only of regime change.

Criminal defense lawyer here (former PD). Your statements re: the necessity of establishing each legal element are obviously correct, and I agree that the critical factor in this analysis is Israel’s intent rather than the intent of an individual person or even an individual military unit.

What do you mean by “violence”? Mass warrantless arrests and violent reprisal of protests by masked unidentified people operating beyond any reasonable oversight is already “violence” I’d support a law enforcement (so, force if necessary) effort to hold those involved who broke the law accountable

Been waiting for this story. ICE deports people to Venezuela three times a week, there are likely many more recent deportees with valid asylum claims in the rubble. Hope that GlobalX crew loses some sleep knowing they flew a planeload of shackled men & women, plus seven children, to their deaths.

Apparently I was obstructing
The county prosecutor called my boss and told him that he was considering filing charges for obstruction against me and a colleague.
ICE showed up at our courthouse Monday. They were looking for my client who was being sentenced on a DUI. They were kind of lurking in the hallway while he was signing papers for probation.
I walked into the probation office and informed my clients (there were several there in the lobby) that the two individuals in the hallway were federal agents and that they were under no obligation to speak to law enforcement (including ICE), show them ID, or answer questions. But that if law enforcement have a warrant or federal agents have an order to detain them that they should not run or resist because "you've seen on TV what these assholes are capable of." I did this in full view of the ICE agents and loudly enough for them to hear me.
The prosecutor can eat a bag of dicks and my boss should join him for not telling the prosecutor to pound sand.

What do you mean “fire blindly”? Seems like the guy had a clear line of sight at a bona fide (though clearly inept) would-be assassin and was the use of deadly force was justified. On the one hand it’s not great that the officer missed, but on the other hand I’m glad no one was seriously hurt!

It reads like the author had a list of things he was ordered to include in the Motion, and then had to get drunk before he could bring himself to write it. I think there’s at least a 50/50 chance that is pretty much exactly what happened.

The wire fraud charges depend on the purpose of the money transfer or source of funds being illegal. That means the DOJ would have to show 1) that $ to informants promoted hate, and 2) the SPLC knew this and was thus lying to its donors. It’s not clear the DOJ even alleged 2) in the indictment.

My reading of the indictment is that the DOJ is alleging that the SPLC’s use of paid undercover informants in various hate groups promoted, rather than weakened, the spread of hate. The allegation not only seems erroneous but also is very likely a legally insufficient basis for the charges.

Thus, if law enforcement agencies encouraged the SPLC to share info about these hate group and the SPLC reasonably relied on that encouragement, then the SPLC has grounds for a Motion to Dismiss and/or an incredibly strong defense. And that’s just one of many potential arguments the SPLC could make

For example, if law enforcement agencies were encouraging the SPLC to continue sharing info (as seems clearly the case) then that seems to either preclude the legal basis for the fraud charges or, at the very least, provides the SPLC with overwhelmingly strong evidence for an affirmative defense.
