The reason I'm kind of a pedant about various past legal developments that are often assimilated to categories like "market reasoning" or "market logic" or the like by critics is that I strongly feel this has a tangible effect of conceding internal coherence to the positions the critic opposes.

My mother Ruchira (Mitra) Paul passed away suddenly last night. July 23, 1951-July 7, 2026. I will have more to write about her later. She was intelligent, curious, beautiful, and unerringly fair-minded even when social conventions were not. Anything I may be able to do in this life comes from that.

Brandeis was (I think pretty clearly?) the best and most all around sensible pre-1940 Supreme Court Justice and interestingly the first minority of any kind to be appointed to the court - which does not precisely prove the rightness of Woke, but doesn't not prove it either

weird asymmetry for much 19c econ? the inframarginal seller (id'd with landowners by eg Ricardo) is presumed to get MORE than his costs (b/c market price set by others' higher cost); but the inframarginal WORKER is presumed to get less than she produces (b/c market wage set by others' lower product)

My view: we need a TVA for energy transmission. It may take a minute, but we can't limit ourselves to public planning and public subsidy. This infrastructure is just too crucial for economic and climate safety to split power and ownership w private firms. And we have to move w purpose.

To be more precise about this: this was the moment I think where ideas about 'who deserves what' got wrongly tangled up with the self coordinating market idea--itself sharpened by the marginal revolution--for the first time. But the SCM has squat to say about who deserves what!! Nothing at all

As Max points out, Republican presidents who do not want agencies to function will actually like this outcome, and they may even take the choice away from Democratic presidents by preemptively firing enough commissioners that the agency lacks quorum before the new president even arrives in office.

I think it was perhaps a bit of a problem that Progressives and institutionalists understood (then orthodox) economic theory better than the judicial conservatives who were their antagonists. They seemed to credit the latter with understanding that they simply lacked.
