I have no idea how viable this is in practice but American policing is pretty rotten as an institution and this seems like a way to give shirking cops the runaround on their resistance to institutional reform

abolish the police (create an alternative public safety organization with better hiring, training, and accountability practices and gradually migrate policing functions over to them, starting with things like welfare checks and expanding until your original police department is vestigial)

Will is 100% right. Has happened to multiple clients of mine. One judge (not my case) has said that this isn't really release and ordered the person *actually* released. But it's forcing us habeas attorneys to win our cases twice (or more)
On September 9, 2026, Respondents permitted Pablo F. to exit the building where 
he was detained, but he was immediately swarmed by four ICE officers and handcuffed as 
soon as he stepped outside. (Doc. No. 25-3 at 4:48:45–4:49:26.)3
 The officers drove him
to the back of the Whipple building and returned him to a holding cell. (Doc. No. 21 ¶¶ 8–
9; Doc. No. 25 ¶ 5.) During this encounter, officers dislocated Pablo F.’s shoulder. (Doc. 
No. 21 ¶ 7.)4
 Pablo F. now bringsthis Motion seeking to enforce the Court’s Order granting 
the Petition.Again, Respondents make no attempt whatsoever to support their assertion that 
Pablo F. was released. Absent any such argument, the Court cannot agree that a reasonable 
person would have felt free to leave when exiting the detention facility and immediately 
being stopped by ICE officers. Likewise, absent some argument, the Court necessarily 
concludes that Pablo F. was subject to restraints not shared by the public generally when 
he took one step outside of the detention facility and was immediately stopped by ICE 
officers who forcibly returned him to a detention cell. Because Respondents do not make 
any legal argument that Pablo F. was ever meaningfully released from custody, the Court 
grants the motion and orders Pablo F.’s release.6
6 To be clear, Pablo F. is not arguing, and the Court is not concluding, that an order of 
release in a habeas matter renders unlawful any future arrests. Rather, the Court reaches 
the narrow conclusion that because Respondents advance no legal argument in this case to 
support their assertion that Pablo F. was released from custody, and because the 
uncontested facts show that ICE officers immediately swarmed Pablo F. as soon as he 
stepped out of the building, Pablo F. was not released from custody.

yeah plus some of the local elections in the TC metro had Ds putting up 90pt margin of victories. can’t say I have any idea what’s going on in the rural areas, but polls here undersold Flanagan’s margin over Craig so hopefully we get a repeat of a left wing overperformance in november

it’s still worth rigorously going through and reducing points of potential abuse though, or else you get the nth case of a cop using flock cameras to stalk an ex. (And that probably includes taking a close look at the process for selecting the people granted power.)

Talking recently to family members of people snatched up and expelled to third countries by ICE, I learned: 1) All of those captured were in 287(g) jurisdictions; 2) None of the family members had known what 287(g) was and had erroneously thought people with no arrests were safe.

The government moving or hiding jailed people to avoid review by courts isn't some loophole in our habeas corpus rights. This government behavior has been considered a violation of the people's habeas corpus rights since at least the Habeas Corpus Act of 1679. en.wikipedia.org/wiki/Habeas_...
Jailors were forbidden to move prisoners from one prison to another or out of the country to evade the writ. In case of disobedience jailers would be punished with severe fines which had to be paid to the prisoner.[5][6]

The lawyer for the Venezuelan man shot by ICE yesterday says he was discharged from the hospital and transferred to ICE detention while the bullet was still inside of him, and that in Pearsall he's not received any pain meds and was forced to sleep on the floor.

The man ICE shot in Austin today is named Wilber Rafael Garces Perez. Per his lawyer, she and Perez’s family were run off of hospital property where he’s being treated and won’t even confirm he’s there because he’s “in ICE custody.” Actual criminals.

Here in North Austin, where ICE agents appear to have shot an individual in his car. I spoke to two of the only witnesses.

Nedevia Bolaños and her husband, Carlos, own a business just off the intersection where the shooting happened. Shortly before 1 pm they says they heard what sounded like two gunshots. Carlos ran out first. A blue Toyota sedan and a black Escalade were stopped under the highway.Combined tweets, cutting tags and other such
 
He said he saw an olive-skinned man, seemingly in his 30s, leaning backwards against his seat. A masked agent was standing outside the car. The agent refused to answer questions. Within a few minutes as many as 10 other ICE agents arrived.

Carlos asked the victim if he was ok. "Yes," the man said in Spanish, but he looked exhausted. Carlos asked why they had shot him. "Because I didn't stop."Combined tweets, cutting tags and other such. 

Bolaños ran up next. She said she continously asked the ICE agents about why they'd shot him and if they were going to render aid. They didn't answer her. It was an APD officer who later arrived and cut open the young mans shirt, revealing a deep hole between his shoulder blades. The ambulance arrived about 10 minutes after and carried him off. "I've never seen all this. Thank God I'm a citizen," Bolaños said in Spanish. "Or I'd be living like this. In a dream of terror."
