Leaving aside the fact that this ain't gonna happen, the Constitution is not what got us here; powerful people able to *disregard* the Constitution got us here. Constitutions can be nice, but short of abolishing the presidency and supreme court, they don't protect against authoritarianism.

A writer’s most unforgivable sin is being boring, which makes saying anything in this time period tough. Whether you’re reporting or commenting, the game is up once audiences are able to classify according to current political taxonomy. You can publish 50 words or 5000, but what you’re producing for most audiences is a compass heading, showing where you reside on a map in relation to Donald Trump. Maybe you wanted to say something else, but the compass reading is the only thing most people care about, so that’s how the thing will be compressed, summarized, and circulated.

It’s fine if you find talking about Donald Trump interesting, or if it’s important to you that neighbors and family receive an unambiguous signal about where you’d like to place yourself on the TrumpScape. You can put out a strong “against” signal in legacy media – that’s allowed – while almost any other strong statement is interpreted in the other direction.

I'm going to try and be as polite as possible about this: this isn't a purity test, this is a "will you defend a minority group when the government is working hard to murder them" question, and acting like it's a wedge issue rather than the entire game is a failure of empathy and historical vision.

Yet these political judgments need to be distinguished from a separate question: what to think about Judge Amy Coney Barrett, whom Trump has told associates he plans to nominate. And here I want to be extremely clear. Regardless of what you or I may think of the circumstances of this nomination, Barrett is highly qualified to serve on the Supreme Court.

I disagree with much of her judicial philosophy and expect to disagree with many, maybe even most of her future votes and opinions. Yet despite this disagreement, I know her to be a brilliant and conscientious lawyer who will analyze and decide cases in good faith, applying the jurisprudential principles to which she is committed. Those are the basic criteria for being a good justice. Barrett meets and exceeds them.

The majority dismissed this idea, interpreting the Lujan precedent to mean that the observers’ aesthetic reaction did not count as concrete and particularized but should be understood as mere “distress at or disagreement with” the government’s actions. To hear the majority tell it, if mere aesthetic objections were sufficient to bring a lawsuit, anyone could bring a lawsuit against the government any time for anything that the plaintiff disagreed with.

The vote that surprises me most in this case is that of Justice Amy Coney Barrett, who clerked for Scalia and ordinarily takes pains to make sure the court interprets his views correctly.

It’s certainly true that if you read Scalia’s opinion in its entirety, his statement about the cognizability of aesthetic injury is what is known as “dicta,” which means words not technically required to reach the outcome in the case. But Scalia most certainly did not reject the plaintiffs’ standing in the Lujan case on the grounds that they were merely expressing disagreement with government policy. Instead, he was careful to say that they hadn’t shown that they had firm plans to visit the endangered species in question. In context, Roberts’s interpretation of the Lujan opinion is superior to that of the majority.

The FBI previously refused to hire job applicants if they admitted to hiring sex workers or stealing from an employer — or engaging in acts of bestiality.

Today, those acts, which are mostly illegal across the country, are no longer automatic deal breakers for applicants to the nation's top law enforcement agency.

In June, the FBI quietly lowered some of the standards it uses when it conducts background checks on would-be federal agents and other personnel. According to multiple sources briefed on the matter, the FBI did so to facilitate hiring in some cases, even if candidates acknowledged they engaged in sexually deviant activities or stole from an employer.

Just a reminder that court expansion is Job #1 for a future Dem president and that any Dem candidate who doesn't say this explicitly is not credible. It's very simple: Do you want nice things? Expand the court. Otherwise, no nice things.
