@mbkplus.bsky.social and I are back to gawk at AI's impact on universities. AI is juicing scholarly outputs, standing in for provosts, receiving credit for discoveries, and "optimizing student and faculty workflows." Is this the new normal or a betrayal of the core mission?

It's clear that the push to use AI in academic settings is rife with contradictions, from Ivy League provosts using AI to write op-eds talking about how students need to have skills distinct from AI to research advances that might come from snooping through supposedly private data. We have thoughts.

I received a similar comment once about a paper on lawyers' careers. I wasn't offended so much as perplexed--shouldn't law professors care about what their students will be doing? Unprofessional is apt.

Just got done recording an episode of the pod in which @profmarkovic.bsky.social compared the current AI free-for-all in academia to baseball's steroid era, which is a really insightful analogy. A powerful technology, fear of being left behind, distorted view of incentives — lots of parallels.

Legal ethics scholars I respect are surprisingly bullish on Jeffrey Clark's appeal. It's important to note that he not only drafted a nonsense letter about election irregularities but did everything possible to make it the DOJ's position--even after he knew its claims were false. See attached.

Yes. It's also inconvenient that legislatures, not courts, established the LLP as an organizational structure.

I doubt that state courts will invalidate prohibitions on MSOs and alike, despite what some advocates are claiming in Illinois and elsewhere. PE is circumventing existing regulations pertaining to fee-splitting and non-competes. No constitutional issue in closing the MSO loophole, imo.

The California legislation is consistent with what courts have been doing and arguably follows from lawyers' existing obligations. But I agree with your larger point--we are absolutely going to see clashes between courts and legislatures on issues such as nonlawyer practice.

Ectopic pregnancy deaths have nearly doubled. It’s worse in states, like Texas, with abortion bans.
After Texas banned nearly all abortions, patients have struggled to get ectopic care. More than 300 patients here experienced substantial blood loss in 2023 and 2024, compared to 2018 and 2019.
