A despairing scenario I’ve been confronted with repeatedly: won’t Dems come back to power, not fix every problem they inherited fast enough, and pave the way for another GOP comeback, like 2010 and 2024? Maybe! But the GOP is really burning up the foundations. 🧵 www.offmessage.net/p/post-donal...

does it "work"? sure, in the same sense that a Ford F-250 "works" to pick up a gallon of milk, but then build your living spaces to accommodate that and you get a society where people are isolated, kids can't go outside and play in the street, and everyone has diabetes because they never walk.

One of the arguments against originalism is that although supposedly rooted in the past, it always seems to lead to the originalist’s preferred political or policy outcome in the present. The one contrary example always offered is AJ Scalia voting to strike down a law banning flag burning.

There's a lot there, including his casual aside that Trump V US (the immunity case) was derived from "constitutional structure," but I was really struck by the opening section on "insecure originalism." Which seems to be: don't worry about sticking to your principles if you don't like the result.
Twenty-first-century originalists should shed this insecure mindset. When originalist analysis seems at first to lead to a result that makes no sense, judges should check their work. An originalist judge shouldn't cavalierly or happily embrace results that defy common sense and should be on guard against subconsciously setting a higher bar for legal arguments that yield outcomes he finds desirable as a policy matter. We must follow the law wherever it leads. That doesn't require a thumb on the scale against appealing outcomes.

Man, imagine you're minding your own business, getting kind of drunk with your friends at a picturesque brewery in Maine, when suddenly John Roberts walks by and you get to start heckling him. Must have felt incredible. That's the dream. www.nytimes.com/2026/10/01/u...
The chief justice used to preside over a Supreme Court whose members were afforded more privacy and freedom than many other public officials. Once, years ago, Mr. Lipson and the chief justice found themselves up the peninsula from Port Clyde without a car, Mr. Lipson recalled in an interview. So he stuck out his thumb by the side of the road and a pickup truck pulled over. He and the nation’s top jurist hopped in the back and hitchhiked back to town.

Now, Mr. Lipson said, he is cautious about introducing his friend to strangers. This year, on an outing to nearby Monhegan Island, people recognized the chief justice as he walked by a brewery and started to chant: You should be ashamed.

The pre-Trump GOP was mostly tilting at windmills. But the fact that their underlying goal (unravel the New Deal) was bad and unpopular doesn't discredit extreme tactics per se. For instance, what if the goal is "rein in or deny legitimacy to Trump's government"? www.offmessage.net/p/the-new-ra...

Why has the GOP been so procedurally extreme for so long? Because Republicans radicalized themselves against the government they were working within. There was a real logic to it, quite apart from the awful substantive vision. Now, Dems are working in a government fully corrupted by Donald Trump...
