I dated a computer scientist for a while and it became clear to me that these AGI worriers were really high modernists: they assume there is Reason and Rationality and that those are law-like, solvable, unique, etc. Turns out you can study these things and those assumptions are pretty shoddy work

I mean I agree that the constant construction view rejects the 18th century popular sovereignty notion of what constitutions do but is that troubling for American constitutionalism per se or just one (admittedly dominant) strand of it? There’s roles for fixed constitutions in the construction view

I think you’re reading “no such thing as the people” as “no such thing as We The People” rather than “no such thing as THE people”. The claim is that there’s no fixed single thing to appeal to, it has to constantly be constructed, not its impossible to construct. That’s how I read it anyway

I think acceptance is supposed to be a distinctive stance that has to do with a disposition to act as if it were true. At least that’s where I’d go next in the literature instead of following your op in treating acceptance as just obliquely returning to belief

Thinking more frequently these days about this bit from Rawls TJ about how the sense of justice most often works in the background and is revealed in what people won't tolerate
"A community's sense of justice is more likely to be revealed in the fact that the majority cannot bring itself to take the steps necessary to suppress the minority and to punish acts of civil disobedience as the law allows. Ruthless tactics that might be contemplated in other societies are not entertained as real alternatives. Thus the sense of justice affects, in ways we are often unaware of, our interpretation of political life, our perception of the possible courses of action, our will to resist the justified protests of others, and so on.
