Looks like s.106 said, quite conventionally, developer or successor in title. If freeholder goes bankrupt there is a possibility (thought not a certainty) that leaseholders would end up as successors in title. Lenders look a bit over-spooked.

Nearly Legal @nearlylegal.co.uk · 03/04/2026
Yes. I think the problem here was that the leaseholders were primarily initial buyers, so in grey area.

Nearly Legal @nearlylegal.co.uk · 03/04/2026
The s.106 sounds fairly standard. The council’s inaction in pursuing the developer and freeholder is another matter.

But I can imagine them having immense difficulty where the council has not actively been pursuing the debt.

Not necessarily the case.

I’m not sure why the council would want to unilaterally rule out a means of enforcing the agreement, in advance.

Nearly Legal @nearlylegal.co.uk · 03/04/2026
I did wonder. But they did at least demand initially in time.

It just opens the door to all developers blowing off s.106 agreements.

Or ‘why haven’t we served a statutory demand on the developer?’

1) Because that opens up a whole load of complex issues. 2) It is coming, slowly.

A big red flag for ever voting Green (unless you are an antisemitic crank). This motion was allowed to go forward to conference, was debated, and failed because filibustered, not because voted against. May yet reappear at a future conference. Just the worst of left antisemitism.

There is a whole world of potential pain for landlords without valid EICRs, but sadly little of it would directly help the tenants.

No, an invalid or missing EICR doesn’t invalidate a s.21. Unlike a GSC.

Somewhat misleading story. MHCLG is not demanding money from leaseholders. It has registered the debt in the administration of the bust freeholder. Leaseholders think this will mean less available to them as compensation, but unlikely there will be much anyway. www.theguardian.com/uk-news/2026/m…
