Trump’s resort to “national security” isn't going to save his actions from unconstitutionality. What he's imposed is a prior restraint, and prior restraints are unconstitutional even in the national security context. See Pentagon Papers (1971). www.washingtonpost.com/business/202...

Trump tells judge media ban is necessary to protect national security
Ahead of a court hearing, the administration cited reports about the White House ballroom and the Iran war to defend its ban against CNN, MS NOW and Politico.

As @jameeljaffer.bsky.social told the New York Times, Trump’s tantrum attempting to ban MSNOW, CNN, & Politico is “clearly unconstitutional because it would punish news organizations for the content of their reporting.” Authoritarian overreach, not American leadership. And yes, it’s impeachable.

The president cited reporting from the outlets that he deemed “fake news.” It was unclear how such a ban would be enforced or defended in court.

Fun fact — and reminder: For all their focus on “officer safety” and arguments about aggressive tactics being necessary, no ICE officer has ever been killed in the line of duty. It is more deadly in the US to be an elementary school student than an ICE officer.

Most of us would struggle to imagine a world in which U.S. soldiers, police officers, Border Patrol agents and elected leaders could be dragged before an international court, tried by judges from random countries across the globe, found guilty under international laws we neither consent to nor control, and then imprisoned thousands of miles from America.

Not sure I can count the ways in which this is unconstitutional, not least that "No Money shall be drawn from the Treasury, but in Consequence of Appropriations made by Law." Minimum, I'd be asking for the required regular "account of the Receipts and Expenditures of all public Money."

Completely agree with @rickhasen.bsky.social. After tonight’s decision, it isn’t just impossible to win a Voting Rights Act claim—it’s also impossible to win a *constitutional* claim against egregiously racist gerrymandering. The supermajority massively expanded Callais. electionlawblog.org?p=156541
The majority's opinion accompanying the ruling is astounding, and in fact is potentially just as significant as Callais despite its brevity and tentative nature given that it is a shadow docket ruling.
The way it is written makes me have no doubt it was drafted by Justice Alito, who has concocted an elaborate edifice across numerous cases to make it virtually impossible for minority voters to elect representatives of their choice.
