I believe South Dakota attempted to go after birth control around 2000 or 2001. It didn’t succeed once cases started going to court, but we have a much different judicial system these days, and Roe V Wade was still in place back then. It isn’t now.

Why do you think the F.C.C. and the Trump administration are so focused on you?

Authoritarians don’t like anybody who doesn’t give them undue dignity. Comedians are anti-authoritarian by nature. And authoritarians are never going to like anybody to laugh at them. The number of newspeople who have said to me or Jon Stewart or any of the guys who do this, “God, I wish I could say what you say on air.” And we can. I think that upsets them. I think it might be upsetting that we really do not live in their world of principalities and powers.

Given that you and other late-night hosts have become political targets, and given how partisan late night has become, do you have any regrets that it’s gotten to this point?

I don’t have any problem with Trump being a Republican. I have a problem with Trump being a complete narcissist who is only working for his own interest and does not appear to care if the entire world burns. That’s not a partisan position. I have eyeballs and ears, and I think calling late night partisan is just roughing the ref. And we don’t even want to be refs, but they perceive us as refs. I reject the partisan description. Partisan means you’re never, ever going to make a joke about a Democrat, and that’s just not true. There’s just no comparison of how fertile the fields are.

ICE has violated almost 100 court orders. Let me say that another way. 100 times ICE was caught brazenly ignoring the law. 100 times a court told them to immediately stop. And 100 times they ignored the order. That's an out-of-control agency that shouldn't get another dime.

Last I check, ethical journalism was to point out the truth, not political sides. If there was more than one side, it was to point out the different sides, no matter how different they were politically. (e.g. - syria, russia, kurdish peshmerga). Political goals in news reporting make it biased.

MONTANA SUPREME COURT: “Transgender discrimination is, by its very nature, sex discrimination,” and is subject to strict scrutiny under the Montana Constitution.

Transgender discrimination is, by its very nature, sex discrimination. Discrimination based on sex is expressly prohibited under Montana’s unique Nondiscrimination Clause––“[n]either the state nor any person, firm, corporation, or institution shall discriminate on account of . . . sex . . . .” Thus, Article II, Section 4 is
unequivocal in its intolerance for discrimination based on sex. Because sex discrimination involves a fundamental right under Article II, the appropriate level of judicial review is strict scrutiny. Snetsinger, ¶ 17.

¶28 Being transgender is also a suspect class under the Equal Protection Clause of
Article II, Section 4,––“[n]o person shall be denied equal protection of the law.”
