The one in which Magistrate Judge Fitzpatrick joins the #WITAOD cult, finding Musk was head of DOGE on Feb. 11 — a date when, per the government’s position in other litigation, no one formally held that role. storage.courtlistener.com/recap/gov.us...
vi. February 11, 2025, Statement by Flon Musk
On February 11, 2025, Elon Musk, a Special Government Employee and head of DOGE
retweeted on X a photo of Ms. Comans along with the statement, "FEMA CFO Mary Comans was just fired for funneling $58M to illegal migrant hotels in Manhattan" and he called it a "criminal
action." The Government concedes and the Court finds that other than the fact that Ms. Comans
had been fired, the post by Mr. Musk was entirely false. The Government further concedes and the
Court further finds that Mr. Musk and officials at FEMA and DHS knew this information was false
at the time it was posted. Based on the unchallenged facts and the fact that Mr. Musk was the head

of DOGE, he knew or should have known that any payments made to state or local governments through a FEMA grant in February 2025 were approved by his subordinates. Finally, the fact that Mr. Musk posted a picture of Ms. Comans to his millions of followers while falsely characterizing
her government service as a "criminal action" was clearly intended to make her afraid. Posting
Ms. Comans' picture served no legitimate governmental interest and was little more than state

DEFENDANT, TIMOTHY BURKE'S, MOTION TO DISMISS THE INDICTMENT WITH PREJUDICE FOR VIOLATION OF THE SPEEDY TRIAL ACT AND THE SIXTH AMENDMENT, AND INCORPORATED MEMORANDUM OF LAW
Defendant, Timothy Burke, moves, pursuant to 18 U.S.C. 8$ 3161-3162 and
the Sixth Amendment, to dismiss the Indictment (Doc. 1) with prejudice. This
case reduces to three facts the government cannot escape: 1) there was no appeal,
2) there was no justification for the delay it caused, and 3) the harm to Mr. Burke
is real, substantial, and entirely of the government's making. Dismissal is
required.UNITED STATES DISTRICT COURT MIDDLE DISTRICT OF FLORIDA

BREAKING: The Supreme Court takes up Trump administration request to review a lower court decision allowing discovery into DOGE. The case is one of three new cases granted today.

CERTIORARI GRANTED
25-1103
U.S. DOGE SERVICE, ET AL. V. USDC DC, ET AL.
25-1343
BLANCHE, ATTY GEN. V. OZURUMBA, IZUCHUKWU
25-7026
The petitions for writs of certiorari are granted.
BERRY, COREY D. V. UNITED STATES

The motion of petitioner for leave to proceed in forma pauperis and the petition for a writ of certiorari are granted.QUESTIONS PRESENTED
The district court in this case entered a wide-ranging and intrusive discovery order against the U.S. DOGE Service (USDS)—a body within the Executive Office of the President tasked with advising the President—to determine whether that body's influence renders it an "agency" subject to the Freedom of Information Act (FOIA),
5 U.S.C. 552. This Court previously granted certiorari, vacated the court of appeals' denial of a writ of mandamus, and remanded for the court of appeals to "narrow" discovery in light of "separation of powers concerns." On re-mand, respondent withdrew several of its discovery re-quests, and the court of appeals again denied the government's mandamus petition without any new analysis regarding the remaining discovery, which includes numerous requests for internal communications and a deposition of USDS's head. The questions presented are:
1. Whether the court of appeals' order departed from this Court's instructions and the separation-of-powers principles that this Court articulated in Cheney
v. United States District Court, 542 U.S. 367 (2004).
2. Whether a court may order broad discovery against an Executive Office advisory body—potentially providing much information sought on the merits of a plaintiff's FOIA claims—to determine whether FOIA's disclosure requirements apply in the first place.

Four days before yesterday’s ICE shooting in the Bronx, Judge Gary Brown of EDNY (Trump apptee) listed 7 outrages in an ICE case before him, including evasive & apparently perjurious testimony, post-hoc sworn arrest warrant containing false info, woeful lack of training … 1/2
The evidence points to numerous failings on the part of both ICE and the officers
who testified, including:
1. evasive and apparently perjurious testimony by the ICE agents, including the
testimony concerning supposed observations of the petitioner engaging in drug
transactions, which bear all the hallmarks of coordinated fabrication,12 the absence of any recovered drugs, paraphernalia or cash from the petitioner,
the failure of the agents to follow up upon these supposed observations or refer
the matter to another law enforcement agency, and the notable absence of any
reference to these observations in the voluminous documentary records, further undermining the agents' testimony;
2. the seemingly reflexive, though false, claims that the petitioner was
"misidentified" as the target of the operation;
3. fundamental misconceptions about ICE agents authorities and duties;
4. illegality of the arrest and detention of petitioner and Concepcion;
5. the post-arrest documents, which not only were procedurally and legally
suspect, but contain false statements;Notably, in its filings, Government counsel has not referenced this testimony, seemingly abandoning any argument predicated upon these sworn assertions by the agents.

6. the database search process used to justify the administrative warrant, as
described by the ranking supervisory officer, which appears designed to generate misleading information in official records; and
7. the inexperience of the agents involved, their woeful lack of proper training, understanding of law, policies and procedures, and their ready recourse to false testimony to conceal these failings.

A federal judge ORDERED the Trump admin to privately show him the memo purporting to justify boat strikes that have killed 234 people in the Caribbean and Pacific. Judge Engelmayer rejected several rationales for withholding the memo from the public and will determine whether to release it.
The Court directs defendants to file the declaration(s), and to arrange for the Memo to be available for in camera review, within two weeks of this decision. See ACLU II, 2016 WL 889739, at *6 (ordering Government, within five days, to produce document at issue and “advise the court who has received [it] (including persons who received it from its original recipients) and for what purpose”); Elec. Defendants are authorized to make appropriate redactions in the declaration as publicly filed, while filing the unredacted declaration under seal. Upon review of these materials, the Court will determine whether to commission supplemental briefing.

NEW / HUGE: Louisiana, Arkansas, Alabama sued nearly three dozen abortion pill providers + a pharmacy and The states asked the Supreme Court to be able to sue New York, Massachusetts, and California to challenge their telehealth shield laws @autonomynews.co storage.courtlistener.com/recap/gov.us...
Dear Mr. Cayce:
I write to notify the panel of two legal developments material to the
panel’s resolution of this case.
First, today Louisiana—joined by Arkansas and Alabama—filed a
lawsuit in the Western District of Louisiana against nearly three dozen
individuals and entities responsible for remotely dispensing FDA-
approved mifepristone in Louisiana, Arkansas, and Alabama. See
Louisiana v. Nouhavandi, No. 2:26-cv-03836 (W.D. La.) (attached). As
the complaint in that case illustrates, none of those individuals and
entities could carry out their current operations without the 2023
REMS’s removal of the in-person dispensing requirement.
Second, also today Louisiana—joined by Arkansas and Alabama—
filed a motion for leave to file a bill of complaint (attached), Louisiana v.
New York, in the United States Supreme Court against New York,
Massachusetts, and California. The bill of complaint challenges the
telehealth shield laws of those states on various legal grounds.
Both complaints explain how Louisiana’s success in Louisiana v.
FDA will eliminate the flood of FDA-approved mifepristone into the
State. Louisiana’s success in Louisiana v. Nouhavandi will eliminate the
2
ability of nearly three dozen of the most prominent actors to illegally send
any abortion drugs into the State. And Louisiana’s success in Louisiana
v. New York will strip all shield-law state residents—regardless of any
back-up drugs they may try to use—of the claimed authority to violate
Louisiana’s laws with impunity.
espectfully,

Okay, to be fair, she simply reiterated Cannon's reasoning and said that Smith had no more authority than Lindsey Halligan. Which is some out of the box thinking, Margot!
38. Attorney General Garland’s decision to ignore the Appointments Clause is more than a mere procedural oversight: It deprived Senator Blackburn and her fellow senators the opportunity to offer their Advice and give (or withhold) their Consent to bestow on Defendant Smith the power to act as a principal law enforcement officer of the federal government. U.S.CONST. art. II, § 2, cl. 2.
39. Defendant Smith lacked all authority to exercise the powers of a Special Counseland was therefore acting as a private individual when he conducted the Arctic Frost investigation. See Larson v. Domestic & Foreign Com. Corp., 337 U.S. 682, 689–90 (1949) (holding that when a “statute or order conferring power upon the officer” is unconstitutional, “the power has been conferred in form but the grant is lacking in substance,” and therefore his actions are considered individual actions). Defendant Smith’s subsequent abuse of the power he exercised from his fictitious appointment as Special Counsel demonstrates precisely why the Senate’s advice and consent are required for such appointments.
