Contrary to statute—but seemingly blessed by SCOTUS’s unitary exec rulings—Trump has declared MSPB no longer “independent.” It must follow his orders. That "collaps[es] the bd’s adjudicatory function into the chain of command whose actions it is tasked with reviewing." 2/3

Due in part to President Trump's termination of an MSPB member before the
expiration of her term, the MSPB currently consists of only two members, both of whom are affiliated with the same political party. In other words, the Board is permanently changed. Indeed, leadership at the MSPB has directed staff to stop describing the board as "independent."
The asserted scope of presidential control extends beyond MSPB members to the
adjudicators who conduct hearings and issue initial decisions. The Executive Branch has taken
the position that statutory protections limiting the removal of administrative judges are
unconstitutional and has declined to defend those protections in court.
232. At the same time, as a result of a series of changes and pronouncements issued by
the Executive Branch, MSPB adjudicators effectively may not adopt legal interpretations that
conflict with the Executive Branch's positions, collapsing the Board's adjudicatory function into
the chain of command whose actions it is tasked with reviewing.
With respect to this
administration's novel "Article II" firings in particular, conflicting statements from various corners
of the government have produced jurisdictional uncertainty and doctrinal fragmentation, leaving
those purportedly fired under Article II without a clear forum for meaningful relief.

Good morning. Federal prosecutors in Chicago filed partially redacted documents overnight in the "Broadview Six" case. The redactions appear to include the signature block (including the name) of one of the attorneys representing the United States government:

A partially redacted motion to seal a petition for order authorizing disclosure. One signature block on the document belongs to Assistant U.S. Attorney Thomas Walsh. The other signature block is redacted.
