What use was it to bring the writer and activist Chanel Miller to campus in the spring just for fraternity brothers to scroll, bored, on their phones as she movingly shared her experience as Emily Doe, the victim of Brock Turner? As I wrote at the time, I was floored and dismayed as I sat in the audience with one of my brilliant undergraduates; we heard Miller’s shattering account of being sexually assaulted by Turner behind a dumpster at Stanford University after a fraternity party. Her talk was riveting, and there was so much to learn from it. And yet many of the male students who hailed predominantly from fraternities — 15 percent of each chapter was required to be in attendance — were so tuned out that Miller commented ruefully: “You know, this has been my hardest gig, because they didn’t turn down the house lights. I’m not sure how you professors do it, because it’s so hard looking out at this sea of mildly disgruntled faces. I mean, I’m sure you’re all very moved, but …,” Miller smiled. The implication being, it didn’t seem like it, from her angle.

Courtney Baker, the farmer, told ProPublica that the case had been dismissed, touting the negative test results as proof that her milk had not caused the outbreak. She stressed that families had knowingly bought milk that was not for human consumption.

Instead, they gave the farmer a cease-and-desist order and a violation notice for operating as a food facility without a valid permit. After the sample she gathered for investigators came back negative for E. coli, the investigation was closed. She was given no penalty.
Excerpt from the conclusion of a California Department of Food  & Agriculture report. The text reads: Based on the information and evidence acquired throughout the investigation, SUBJECT promoted raw milk for sale and sold unapproved milk products in commerce without a CDFA license. A sample was collected and tested for pathogens, confirming that the milk contained residual Phosphatase. Although SUBJECT violated the FACs and we confirmed that her milk products were improperly labeled, I was unable to show that she sold milk intended for human consumption. If this had been proven, the case would have been referred to the Riverside County District Attorney's Office for potential prosecution. SUBJECT received a Cease-and-Desist letter from CDFA and a Notice of Violation from DEH. The case will be closed, pending additional information or violations.

But even so, the state didn’t seek penalties against Courtney’s farm, even though internal emails reveal investigators had text messages that they said showed she "clearly" knew the raw milk was going to a child.

California requires a license to sell raw milk for human consumption. Doing so without a license can lead to fines of up to $10k and jail time of up to a year. But there's a loophole: unlicensed farms can sell raw milk as long as they label it as pet food.
The sale of unapproved milk products without a CDFA license is in violation of the California Food and Agricultural Code, as follows:

It is unlawful for any person to sell, give away, deliver, or knowingly purchase or receive any milk, cream, product of milk or cream, imitation milk, imitation cream, product resembling a milk product, or any substitute for any milk product which does not conform to the standards which are established by this division (a misdemeanor).

It is unlawful for any person to sell, give away, or deliver, or to knowingly purchase or receive any impure, polluted, tainted, unclean, unwholesome, stale or unadulterated milk or cream, or any product which is manufactured wholly or in part from such milk or cream

It is unlawful for any person to sell, give away, deliver, or knowingly purchase or receive any milk or any product of milk which has been produced or handled in or by a dairy farm, milk products plant, carrier, store, or depot, that is in an insanitary condition.

Article excerpt: The next day, however, Marris saw that Baker had recently responded to someone in the Facebook group looking for raw goat milk: “I have raw goat milk from a clean tested herd in wine country … We milk 2x a day so it is always super fresh.”

Marris was aghast, squeezing the sides of her phone to capture what was on the screen.

“Out of respect, I’m giving you a heads up,” she texted Baker. “I wasn’t going to EVER post anything, but I’m appalled that you’re advertising the milk as tested and safe when you haven’t been able to test for that deadly strain of e-coli.”

Marris then typed up a detailed description of what had happened to her daughter.

“My 17 month old almost died this week,” she wrote. “I NEVER WANTED TO have to call her out on this, but it’s prudent that she take a break, make sure she tests for THIS SPECIFIC strain and ensure the milk is safe before resuming sales.”

That day, Emily visited the farm, met its owner Courtney Baker, and bought a gallon of raw goat milk. She explained it was for her toddler. Later on, Courtney texted to see how the child was liking the milk. "She is gobbling it down! 💜” Emily thought she had found a solution.

Last year, Emily Marris started a new medication for chronic hip pain that could pass through breastmilk. She needed to find an alternative for her 1-year-old daughter Brooklyn. In a Facebook group run by her chiropractor, she saw one of his posts, which made her curious about raw milk.
