The fast-growing firm has poured nearly $2.5 million into California’s Democratic Party, state races and business-friendly political action committees this cycle as it ramps up its political operations nationwide, according to state campaign finance records. It’s picking favorites in competitive contests, siding with moderate incumbents in red-on-blue fights and wading into intraparty battles on both sides of the aisle.

And while Kalshi says its giving is designed to be bipartisan, there’s a clear winner: Democrats. On Saturday, the California Democratic Party reported a whopping $2 million contribution from the company.

It’s the latest instance of tech firms using cash to sway state politics. Uber and Airbnb have built political war chests to defend their interests in California. While Kalshi’s spending hasn’t yet reached the eye-popping sums those giants have invested in ballot fights, the firm’s maneuvering so far mirrors Uber and Airbnb’s strategy of playing in key races."

Newsom’s reluctance to rile his past, present, and (he hopes) future funders seems to have trickled down to the ranks of the elected. His certain successor as governor, Xavier Becerra, has joined Newsom in opposition, as has Los Angeles Mayor Karen Bass. The mayor’s challenger in the upcoming midterm election, L.A. city council member Nithya Raman—an ostensible socialist who is a member of DSA, which has backed her candidacy—has taken no position on the measure. This puts her to the right of actual capitalist Tom Steyer, the billionaire progressive who sought the governorship in the state’s June primary.

Despite the measure’s heavy support from rank-and-file Democrats, the only other elected Democrat of note to back Prop 40 is Rep. Judy Chu, who represents L.A.’s San Gabriel Valley in Congress. Subtracting Chu and Khanna from the quavering pack, that leaves 41 California Democratic members of Congress who’ve either opposed the measure or have remained mum on the subject. Also: many of those same pundits think they are "data-driven" because they survey voters and conduct focus groups. That's so damn quaint. Trump's wealthiest allies purchased all the largest social media platforms+all the largest mainstream media outlets. Focus groups CANNOT measure those effects.

Really important point here -- oligarchy isn't a one party problem. Economic elites don't see that economic regulations are not costs to be eliminated but rules necessary for a fair economy & just society. If we don't reform the courts, citizens will become increasingly frustrated with both parties.

Update: I had a conversation that convinced me it wasn't responsible to suggest the fossil fuel industry wrote this provision. The identity of the party that wrote it or pushed for it doesn't change the problem, but I shouldn't have made any assumptions about who that was.

Meanwhile, because the baseline for renewables is mostly delay or rejection under Trump, it's not clear there's a plausible path to remedies for renewables that get delayed under a future administration. (Not advocating otherwise; this is bad policy. Just noting the asymmetry.)

Renewables won't benefit from this anytime soon if ever, thanks to the 5-year historical baseline period. Under Trump, all fossil fuel projects are approved and most renewables are delayed (or worse). Four years of that and any rejection or delay of fossil permits will look like "disparate impact"!

There is much that is analytically wrong with Jane Flegal's support of the permitting deal. Should inject caution & humility to grasp of the scope of this very complicated, hotly contested brawl. And, to me, suggests the secrecy & urgency behind this bill is designed to override legit opposition.

(During Gorsuch’s appearance, Shapiro helpfully read only one ad for a tax resolution firm promising to help delinquent viewers quickly and easily settle their outstanding debts with the Internal Revenue Service.) Gorsuch spoke at the presidential libraries of Richard Nixon and Ronald Reagan and guested on Firing Line, a PBS opinion show hosted by the conservative commentator Margaret Hoover. He spoke to Kyle Peterson of the staunchly conservative Wall Street Journal editorial board, and to New York Times opinion columnist David French, previously of the National Review and the Dispatch.

It alleged he had agreed to pay $3.5 million to a former student he had sexually abused.

Hastert was never charged with a sex crime because the statute of limitations had expired but admitted at his April 2016 court sentencing that he “mistreated” and “took advantage” of some of the teenage wrestlers he coached at Yorkville High School, where he worked from 1965 to 1981. Federal prosecutors alleged at the time he had molested at least four boys.

As part of a plea deal, Hastert acknowledged that he had illegally avoided reporting requirements associated with bank withdrawals he made for hush-money payments. Judge Thomas Durkin called Hastert a “serial child molester” at the sentencing.

Insightful legal analysis of a highly problematic component of the Senate permitting deal (Sec. 1402) highly touted by bill proponents as a solution to Trump's War on Renewables but is in fact a major gift to all developers—in particular fossil fuels—that will hobble a future POTUS' climate action.
From attorney Matthew Littleton: "Section 1402 of the draft bipartisan permitting bill is deeply problematic. The apparent goal is to stop Presidents from imposing hard or soft bans (“pauses”) on development of certain types of energy resources. Whatever energy policy the next President pursues, however, the likely outcome of this provision is a massive public subsidy (hundreds of billions of dollars) for new fossil-energy projects, with little to no benefit for clean energy. Here’s why. 

Section 1402 authorizes suits by developers for money damages against the United States in any federal district court where part of the proposed project is located. A developer must allege that the government missed one statutory deadline to decide on its application for a permit, right-of-way, etc. It’s up to the judge when the agency’s review clock began (there’s often dispute over when the permit application is complete) and when it ends (there’s often dispute over the degree of environmental review required). So even if the government acted in good faith to meet what it thought was the deadline, the judge can decide there’s a delay. 

Next, the developer has to show a “pattern of disparate treatment,” meaning a substantial increase (as compared to the most recent 5 years) in the percentage of projects of this type that, in the judge’s estimation, were either delayed or “improperly denied.” Here’s where clean energy comes up short. Because the current Administration hasn’t moved those projects, an indefinite stall (including by a new President that continued it) would be no worse than the baseline. Lawsuits can’t be filed until late 2027, by which time the baseline will be dominated by Trump's practices."Part 2 from Littleton: "Next, the judge decides whether the developer’s permit, were the agency to grant it, would be subject to cancellation for violating federal law. The question seems to be whether there is a hypothetical permit the agency could issue that would survive judicial review. That’s a low bar, given the deferential standard of review applied to agency factfinding and “public interest” determinations. 

Section 1402 “entitles” a developer that wins its case to (1) “injunctive relief, as provided by applicable Federal law” (meaning an order that the agency decide on the application? issue the permit?); (2) attorneys fees and litigation costs; (3) “economic damages, including any costs associated with the applicable denial or delay, as the court determines appropriate” (what else is “included”?); and (4) “damages in an amount equal to not less than 50% and not more than 100% of the total reasonably expected cost of construction of the project.” The last of these four must be repaid if the project isn’t built; the developer keeps the rest of the money regardless. 

A single claim under Section 1402 could top the total amount (~$40b) the government has paid out in all Judgment Fund claims over the last decade. This provision puts judges in real control over energy policy through the power of the purse."
