La décision médicale d’arrêter les traitements de maintien en vie d’un patient qui
avait rédigé des directives anticipées n’a pas emporté violation de la Convention
Dans son arrêt de chambre1, rendu ce jour dans l’affaire Medmoune c. France (requête no 55026/22),
la Cour européenne des droits de l’homme dit, à l’unanimité, qu’il y a eu :
Non-violation de l’article 2 (droit à la vie) de la Convention européenne des droits de l’homme.
Dans cette affaire, les requérantes se plaignent d’une atteinte au droit à la vie de M. A.M.– leur frère
et époux – résultant de la décision médicale d’arrêter les traitements qui le maintenaient en vie. La
particularité de l’espèce tient à la circonstance que le patient avait rédigé des directives anticipées,
lesquelles visaient à la poursuite des traitements de maintien en vie au cas même où il aurait
définitivement perdu conscience et où il ne pourrait plus communiquer avec ses proches.
En premier lieu, la Cour juge que le cadre législatif français est compatible avec les exigences de
l’article 2, y compris en ce qui concerne la faculté de ne pas suivre les directives anticipées du patient.
Selon la Cour, le choix opéré par le législateur français s’inscrit dans la marge d’appréciation dont
disposent les États parties en la matière pour décider des critères à prendre en compte mais de la
manière d’en assurer la pondération afin de ménager un juste équilibre entre les intérêts concurrents
en jeu.

La Cour conclut que les autorités internes se sont conformées à leurs obligations positives découlant
de l’article 2 de la Convention. Il n’y a donc pas eu violation de cette disposition.
