If in the next three years we don’t substantially reform the Court and throw Alito’s entire jurisprudence in the trash (and I mean all of it)… we will have allowed this rightwing politician to have made the US substantially more fascist, against the popular will.

Barrett crossed over, so to speak, on the tariffs case, the National Guard case, the mail-in ballots case, and the mifepristone case.

Why do we think these cases are necessarily against her political views?

She’s a staunch, longtime conservative.

Of course. But I can find conservatives who hate tariffs and think the Federal Reserve should be independent, right? Or who think that Trump is being stupid on mail-in ballots.

All of those opinions are certainly against the position of either the Trump Administration, the R.N.C., or the Republican powers that be. And by the way, I would add, birthright, of course, to that as well, yeah.

That’s the reason I brought up the nineteen-eighties Reagan Justice Department. That could be the type of conservatives they are.

Yes, Congress should be able to do these things. A court this contemptuous of Congress deserves to be packed by Congress, not only to correct these disastrous precedents but also because Congress needs to show both Article II and Article III who’s boss.

Big surprise. SCOTUS says Trump can fire anyone from independent agencies, except the Fed. For some reason, ungrounded in the Constitution, the federal reserve is unique. (The reason is that the Justices have financial investments and value them.) Couldn't be more nakedly political.

The irony of the MAGA justices’ complete arrogance in believing that they - the Justices most historically removed from the founding - should completely rewrite the Court’s Constitutional position on the separation of powers based on some perceived authority rooted in “originalism.”
