If you think the burden of proof for rape cases should be something less than beyond a reasonable doubt, you'll find a lot of powerful people agreeing with you because they would love to be able to have that power.

I think it’s important to explore these comments and the political dimensions of male supremacy because the GOP is clearly becoming *more* hospitable to these views as it becomes more authoritarian. There is a generation of young men coming up in this. www.liberalcurrents.com/the-illusion...
You might ask why it's worth dredging up all these bilious comments. But these are coming from major media figures on the American right. Moreover, Hanania has, as I noted in a recent column, ingratiated himself with mainstream media outlets and even writes regularly at the Boston Globe. As fraternity members at one of America's major elite universities, the young men in question are well-positioned to become leaders in their chosen fields and even elected officials. The networked effects of both Ivy degrees and fraternity membership can be considerable.
Consider the Young Republicans group chat messages that leaked last year, featuring dehumanizing jokes about rape and homosexuality. In those messages, exposed by Politico, they glorified mass rape as a tool of conquest:
"The Spanish came to America and had sex with every single woman."
"Sex is gay"
"Sex? It was rape."
"Epic"This was a chat for Young Republicans, the future of their party. And it reflects dynamics we see across American society, and especially online and on the right, of young men being drawn to a culture of male supremacy and rape enthusiasm. As I wrote then, "In the context of sex, [male supremacy] comes down to a wholesale rejection of sex as a consensual act for the enjoyment of both parties."

As I noted here at Liberal Currents last year, rape is integral to authoritarian politics. Mussolini was a rapist. Francisco Franco imposed a hardline Catholic dictatorship in Spain in which women were expected to serve the nation by serving their husbands. Lavrentiy Beria, head of the Soviet NKVD during World War Two, leveraged his position to engage in serial rape on a prolific scale. As Ruth Ben-Ghiat observed in her book, Strongmen, "The strongman would be nothing without bodies to control." And authoritarianism offers up these bodies to its most dedicated foot soldiers, a point on which Beria serves as a good reminder.Yes, in this case, we are talking about the control of women's bodies. But that doesn't mean the male form doesn't enter into it. In fact, it's the male body that retains its specialness. This fixation moves, sometimes rapidly, from obsession to revulsion. We see that in the language of incels like Nick Fuentes, who has proclaimed that
"dating women is gay, having sex with women is gay. And having sex with men is gay." And we see that preoccupation in Walsh as well. When one commenter asked if the Cornell fraternity brothers should be considered "whores," Walsh replied, "Yes, and gay. But they aren't rapists. That's the point here."

And I don't even mean getting convicted. When you lower the bar for prosecution, that means innocent people being arrested and held in a cell before they can even defend themselves. That does immense damage to their lives. And we *already* incarcerate the most people on the planet.

I don't care what most would think. Mob rule is bad. I care about what the evidence is and what the burden of proof is and what the jury thinks about those things.

I don't think the country with the highest incarcerated population has a problem with not prosecuting enough. I think seeing the outcome here, which is an injustice, and thinking "we need to punish people more" instead of "we need to build a better society" is short sighted.

"we are not talking about innocent people" as far as the law is concerned, you are. No one is saying you can't think they're guilty. But you're saying the standard for prosecution should be lowered. You specifically said you don't just mean in this one instance too.

And if you demand that the prosecutor prosecute more so you feel better, that's what will happen, more innocent people losing their jobs, their homes (even if they are acquitted), and their freedom.

There were obvious mistakes made here in this case by lots of people, but I don't think this is one of them. You do not want a justice system that prioritizes prosecuting loser cases to appear like a fighter *more* than already happens. Innocent people shouldn't have to deal with trials.

High win rate for prosecution isn't about padding stats (or shouldn't be) it's about justice meaning not prosecuting loser cases is a way to protect everyone's rights

You shouldn't prosecute cases you don't think you can win because if you don't think you can prove someone's guilt beyond a reasonable doubt, it would be unethical to prosecute someone presumed innocent anyway. This would be a terrible standard.

And so the distrust of democracy among market-sympathetic liberal and conservative thinkers is a deep and pernicious mistake. It typically juxtaposes democratic decision-making to market decision-making, as if “democracy” were just a synonym for “politics” or “the state,” as if the contrast to “democratic” were “economic” rather than “autocratic.” We should sharply distinguish the question of how much the state ought to do from the question of how much democratic control of the state there ought to be, and thereby stop allowing market-liberal critiques of too much politics to be used as any kind of intellectual cover for the erosion of democratic government.
