In the wake of ICE’s shooting, NYC must end all forms of collaboration with ICE. We cannot claim to be a sanctuary city when the NYPD enables ICE's abuses or the NYC Department of Corrections regularly transfers people to ICE custody.


No one should be funneled into the hands of this violent, rogue, and unaccountable agency. We can close the gaps in our city’s sanctuary laws and protect New Yorkers from ICE by passing Intros 1077 & 1078, and Intro 209, the NYC Trust Act.


It’s time to end the city’s relationship with ICE, full stop.

ICE at airports: Risks of domestic travel
August 2026 update

Community members have been arrested by ICE at airports when they were trying to fly domestically, creating fear.

TSA has been sharing people’s information with ICE to target them for detention and deportation.We do not fully know who is being targeted.
All people who are undocumented or have temporary or expired immigration status face some risk. However, we believe there is currently higher risk for:
People with deportation orders even if they have some form of protection (*note: this includes people with Withholding of Removal and protection under the Convention Against Torture).

People with prior arrests or cases in the criminal legal system who are more likely to have an ICE administrative warrant.

People who have overstayed visas, or whose temporary immigration status has been revoked (for example, TPS).

Note: People targeted by ICE at airports flying domestically have included those with pending cases in immigration court or who have filed certain applications with USCIS, including asylum applications.What should I do if I plan to fly domestically?

Learn if you have a deportation order (an “order of removal”). If you have an A number, call 800-898-7180 or visit the EOIR website. If you are unsure, consult with an attorney.

Give a trusted loved one your A number (if you have one) and access to documents related to any immigration or criminal legal case.

Share your travel information with your loved ones and keep them updated as you travel so they can find help if needed.

The TL;DR

The new law bans 287g deportation agreements –  that’s a good step! But, the entanglement of local police with ICE is one of the biggest engines of mass deportation across the US, and there are a lot of urgent protections this new state law doesn’t have. So we have a lot more work to do.

287g deportation agreements - sometimes described as a "formal agreement," are a core part of Trump’s mass deportation agenda. Banning these agreements - over a dozen in NY state - is an important step.
287(g) AGREEMENTS

Formal agreements between law enforcement agencies and ICE to officially “deputize” a certain number of local officers as ICE agents. The program has three levels: 1) Warrant Service Officer, 2) Jail Enforcement Model in jails, and 3) Task Force model which involves local police conducting immigration arrests/raids in public.

A law enforcement officer specifically asking an individual – regardless of an arrest or not, about their immigration status. This information may then be used to collude with ICE and funnel someone to ICE.

Why does this matter? The entanglement of local police with ICE is one of the biggest engines of mass deportation across the US. The tactics of notifying ICE and transferring someone from jail/state prison into ICE custody are directly connected to one another.
Notification to ICE

A law enforcement agency calls ICE or Border Patrol to notify them when a community member is about to be released after an arrest or when a sentence has been completed. Instead of going home to their family, the community member is instead whisked away by ICE to a detention center.

Do these states protect people from this form of collusion?

Open cases show up in border officers' system. They may also ask questions about suspected criminal activity. Green card holders with open criminal cases should consider consulting an immigration attorney before travelling internationally to understand the new risk.
How would border officers know about an open case? 
When returning from international travel, open cases will show up in the border officer’s system. Border officers may also ask questions about any suspected criminal activity. Anything you say about a prior or open criminal case to an officer can be used to determine whether there are grounds to place you in deportation proceedings.

What should I do if I plan to fly internationally?
Green card holders with open criminal cases should consider consulting an immigration attorney before traveling internationally to understand their risk.

NOW: Green card holders with *any* past criminal convictions may face risk of detention, deportation, and loss of their green card when returning to the US from international travel. Green card holders with open criminal cases may also face a risk when returning from international travel
Who is impacted by this decision?
Green card holders with any past criminal convictions may face risk upon return from international travel of detention, deportation, and loss of their green card. The Court’s decision makes clear that now green card holders with open criminal cases likewise face a risk. 

It is important to note that green card holders cannot be deported without having their case heard before an immigration judge.

Generally, green card holders are free to travel internationally and have important protections when they return to the United States. However, there are exceptions.  

Certain convictions can put green card holders at risk of detention and deportation if they leave the country and return – even if those convictions would not put them at risk if they remained in the United States. In those cases, border officers may treat green card holders as though they are “seeking admission,” meaning, as though they are requesting permission to enter for the first time, stripping them of the protections of a green card holder.

The Court decided that, in some situations, border officers can treat green card holders returning from travel abroad as though they are seeking admission to the United States based simply on an open criminal case, taking away some of the protections of green card holders.
