Our two papers on abortion bans and fertility/infant mortality are now out. In 14 states w/ abortion bans, fertility increased 1.7% and infant mortality increased 6%. Key takeaway is that these impacts were disproportionately felt among those w/ greatest structural disadvantages. Links below.

Holy crap. The DOJ is arguing that the President can unilaterally deport anyone he wants without ANY statutory authority, just on his inherent authority as President over national security. That is a terrifying claim to make and not one that has ever been recognized before in US history.
Beyond the statute, the President’s inherent Article II authority is plainly
violated by the district court’s order. As a function of his inherent Article II authority
to protect the nation, the President may determine that TdA represents a significant
risk to the United States, that it is intertwined and advancing the interests of a foreign
government in a manner antithetical to the interests of the United States, and that its
members should be summarily removed from this country as part of that threat.

In 1993, the Supreme Court said that immigration court proceedings are “domestic procedures ” which are not relevant outside the United States, specifically as relates to people detained at Guantánamo Bay. So I just can’t see how it would be legal to use Gitmo for “domestic” ICE detention purposes.
Sale v. Haitian Centers Council, Inc., 509 U.S. 155 (1993). In sum, all available evidence about the meaning of § 243(h)-the Government official at whom it is directed, its location in the Act, its failure to suggest any extraterritorial application, the 1980 amendment that gave it a dual reference to "deport or return," and the relevance of that dual structure to immigration law in general-leads unerringly to the conclusion that it applies in only one context: the domestic procedures by which the Attorney General determines whether deportable and excludable aliens may remain in the United States.

Something I'd note is that, while there are pretty much no details or useful information of any kind in this Guantanamo "memo," a _conspicuously_ absent detail is the number of migrants they expect it to hold. Which means the only source we have for the 30K number is...Trump.

The birthright citizenship executive order requires the federal government to issue, or recognize, documents affirming the US citizenship of babies born in the US after mid-Feb 2025, only if at least one parent is a US citizen or green card holder. (Notably, a temporary visa isn’t enough.)

We're constantly fed a narrative of unlimited numbers of *potential* immigrants. The truth is, by a long way, most people stay put. And if they do move, they move within the borders of their country. And if they do leave, they go next door. And if policy allows it, they tend to go back again, too.
