Update to the Texas v. Kennedy case. Some community integration regulations from Section 504 of the Rehab. Act of 1973 will no longer be in effect. Full statement at: www.aapd.com/aapd-statement-on-ruli…
Today, a judge sided with the Department of Justice (DOJ), Department of Health and Human Services (HHS), and Texas, Alaska, Florida, Louisiana, and Montana in the Texas v. Kennedy case.This will end some of the 2024 community integration regulations under Section 504 of the Rehabilitation Act of 1973. This is a step backward for our
community. However, the judge did not find that Section 504 or the community integration mandate are unconstitutional.Remember: We still have rights. The Americans with Disabilities Act is still the law. Section 504 is still the law. The Olmstead decision is still the law.

On MAP-It, the Medicaid Action and Policy Impact Tracker for Disability and Aging Supports. MAP-It will help ensure that Medicaid policy changes affecting home and community based services do not happen in the dark. By making state-level actions visible and understandable as they occur, the project will support people with disabilities, advocates, and community organizations to respond early, engage effectively, and hold decision-makers accountable.

AAHD is proud to celebrate the Americans with Disabilities Act (ADA) 36th Anniversary. On July 26th we uplift this important civil rights law that prohibits discrimination against individuals with disabilities in all areas of public life, including jobs, schools and transportation.
The Americans with Disabilities Act (ADA) passed in 1990. This landmark civil rights law prohibits discrimination against people with disabilities in all areas of public life. Along with Section 504 of the Rehabilitation Act, the ADA established a right to community living over

which reinforced this right. In the Olmstead v. L.C. decision, the Supreme Court affirmed that institutionalization is a form of discrimination against disabled people prohibited by the ADA. This ruling established a mandate for states to provide supports in a community setting. Olmstead established an end to the era of segregation for disabled people. The decision still stands.We call on state leadership to commit to Olmstead & build a nation where community living is universal. * On this day in 1999, the Supreme Court made an important decision in disability law. The court case is called Olmstead vs. L.C.
* The Supreme Court sided with two disabled women, Lois Curtis and Elaine Wilson. Lois and Elaine lived in institutional settings for many years. However, they did not want to live there. They wanted to live in the community. The state did not want to help them leave institutional settings.
