Fred B. Jacob Appointed Chief Counsel to Board Member David M. Prouty
David M. Prouty, Member of the National Labor Relations Board, announced today the appointment of Fred B. Jacob as his Chief Counsel. Member Prouty will begin his second five-year term as a Board Member on August 28, 2026.  Mr. Jacob replaces David I. Goldman, who is returning to his prior position as an NLRB Administrative Law Judge.

3) Finally, as others like @nicholasbednar.bsky.social have said, the Court's silence ala Justice Sotomayor's concern that Slaughter will swallow civil service protections is, um, troubling. The Court ❤️ Myers, which protected subordinate federal employees, so maybe it's ok? (6/7)

It's equally about Congress's power to enact laws necessary & proper to carry out all the powers assigned under the Constitution, to all branches. Art. I not only got no love, it got no attention. At the very least, the Court should balance these competing constitutional interests. (5/7)

1) No major surprises in the Court's opinion. It tracks the arguments the Court has been making since 2010; there's a direct line from Free Enterprise Fund to Seila Law to Collins to Slaughter. Read together, they feel like a serial, each episode inching towards the inevitable conclusion. (2/7)

Forthcoming in the Administrative Law Review this fall, I contend that the Due Process Clause protects agency officials from political interference in adjudication. While the end of independence is a mixed bag at best, the Constitution guarantees that politics must not enter the courthouse door.

As a poor student, I definitely couldn't afford the original art (to my dismay!), but we did make a t-shirt. The best thing I've ever done with AI is to sharpen the crummy photo of my faded tee to make the image look almost as good as new!

Produced for Operation Dixie, the CIO's post-war effort to organize the South, the comic retconned bibilical tales into stories of worker empowerment. My favorite is its retelling of the Passover story -- Pharoah refusing "to bargain in good faith" and ordering an unfair "speed-up."

My article contends that the Fifth Amendment's Due Process Clause will mitigate the loss of removal protection for NLRB members, protect parties' right to a fair and impartial trial, and provide a modicum of agency autonomy even if the Supreme Court strikes down Humphrey's Executor.
