Wie berechnet sich die Frist für Gerichtsanträge wegen Informationsbegehren an private Informationspflichtige (in § 14 Abs 2 Satz 1 IFG)? Also etwa an den Tiergarten Schönbrunn? Bei dieser Frage waren Literatur und Verwaltungsgerichte uneins – nun hat sie der Verwaltungsgerichtshof geklärt. 1/5

"§ 14. (1) Über die Nichterteilung der Information durch Stiftungen, Fonds, Anstalten und Unternehmungen, soweit diese nicht mit der Besorgung von Geschäften der Bundesverwaltung oder der Landesverwaltung betraut sind, entscheidet
1. das Bundesverwaltungsgericht, wenn Stiftungen, Fonds oder Anstalten, die von Organen des Bundes oder von hiezu von Organen des Bundes bestellten Personen (Personengemeinschaften) verwaltet werden, oder Unternehmungen, an denen der Bund alleine oder gemeinsam mit anderen der Zuständigkeit des Rechnungshofes unterliegenden Rechtsträgern zu mindestens 50 vH des Stamm-, Grund- oder Eigenkapitals beteiligt ist oder die der Bund allein oder gemeinsam mit anderen der Zuständigkeit des Rechnungshofes unterliegenden Rechtsträgern durch finanzielle oder sonstige wirtschaftliche oder organisatorische Maßnahmen tatsächlich beherrscht, die Information nicht erteilen;
2. im Übrigen das Verwaltungsgericht im Land.

Sofern die Rechtssache nicht zur Zuständigkeit des Bundesverwaltungsgerichts gehört, ist jenes Verwaltungsgericht im Land örtlich zuständig, in dessen Sprengel die Stiftung, der Fonds, die Anstalt oder die Unternehmung ihren oder seinen Sitz hat. Lässt sich die Zuständigkeit danach nicht bestimmen, ist das Verwaltungsgericht im Land Wien örtlich zuständig.

(2) Wurde die begehrte Information nicht erteilt, kann der Informationswerber binnen vier Wochen nach Ablauf der Frist zur Informationserteilung einen Antrag auf Entscheidung der Streitigkeit durch das Verwaltungsgericht stellen. Gegen die Versäumung dieser Frist ist auf Antrag des Informationswerbers die Wiedereinsetzung in den vorigen Stand zu bewilligen, wenn dieser glaubhaft macht, dass er durch ein unvorhergesehenes oder unabwendbares Ereignis verhindert war, die Frist einzuhalten und ihn kein Verschulden oder nur ein minderer Grad des Versehens trifft."

Why I enjoy my work: Under Austria's new #FOIA law, state-owned enterprises have to provide information upon request similarly to the state. If they refuse, the applicant can seek relief with the administrative courts.

I think a lot of people get very broad ideas in their head that they're sure would make sense if they could just write them down. They don't realize that in the process of trying to write actual sentences and paragraphs, they end up discovering lots of inconsistencies and unjustified assumptions.

Bad legal writing is often the product of bad legal REASONING and so you can't separate the "important" stuff from the "boring" stuff the way that the legal AI evangelists assume.

The opposite is also often true: Because the writing is not used as an opportunity/time to properly reason (instead treated as "just gotta write something down real quick"), the reasoning will be bad.

One thing that AI evangelists seem to assume, particularly legal AI evangelists assume, is that the thinking and analysis is quick, and the writing is just tedious busywork that slows us down. But the writing IS the thinking and analysis. You work out the thinking and analysis by writing it down.

This is very much how I work and feel - and I feel strongly about it. However, I have met lawyers who are different (can you imagine??). They need to talk to another person (not just themselves, not a recording device) to actually *think*. Blows my mind every time.

Schon wieder eine Rekord-Geldbuße im österreichischen #Kartellrecht: Kartellgericht verurteilt STRABAG zu €146 Mio, nachdem die @bwboesterreich.bsky.social feststellte, dass STRABAG im Baukartell-Fall als Kronzeugin nicht alle Informationen offenlegte. STRABAG wird kein Rechtsmittel erheben.
