Truth and reconciliation commissions are only one transitional justice tool among many. They only work under very specific conditions, and often fail. Transitional justice is a complicated field, and when done wrong tends to blow up in your face. It’s an important conversation that requires care.

here’s the problem with the framing. *reconciliation* even in the south africa context could only come *after truth*. put away the R and focus on T. ppl have to realize that not everything will be subject to criminal or even civil process. so what then? ignore? or find creative ways to do justice?

absolutely. this was always my understanding: that a full and accurate accounting, in which the perpetrators admitted to what they had done was worth the price of limited or in some cases even total absolution for some of the offenders.

This is absolutely correct, but I worry that "truth and reconciliation" will sound too foreign to Americans who have long been allergic to truth and/or reconciliation. I'd just say "we're finally going to hold people who broke the law and violated the Constitution accountable for their crimes"

If I were in government right now, this is what I would be spending all my time on: Fines, hearings, shame – none of it's changed the behavior of Big Tech. But data centers give you more leverage than you have *ever had* to force Big Tech to renegotiate its social compact with the American public.
