Heard from Mark Tushnet who said in 1972 at least the procedure was it could be five bur only if one of the dissenters agreed but it did take six in that sense. It would be nice if these rules were actually written down.

Hey SCOTUS nerds, did we know summary reversals take six votes? I ask because the Court issued a summary reversal of an important Montana state supreme court decision trying to distinguish Citizens United, 5-4. That was 2012.

FWIW, if Griswold is “an interpretation of the Constitutional text,” as Alito says, so is everything which means text doesn’t matter. Which in constitutional litigation is true. So let’s not pretend.

For many lethal injections the drugs are bought on the black market and no real medical personnel are involved. Torture happens. Really. It’s literally cruel and unusual.

All this talk about Alito is pretty silly. He’s not an Originalist. He’s a GOPist who privileges religion, hates unions (a lot), and has no empathy for the poor and powerless while favoring the rich and powerful. The rest doesn’t matter. Mostly, he’s a GOP partisan.
